  1. That piece of land described in the Second Schedule hereto, vested in the corporation of the County of Taupo, is hereby vested in the corporation of the Borough of Taupo, in fee simple as and for the construction of certain waterworks, under the provisions of Part XVII of the Municipal Corporations Act 1954.

  2. The District Land Registrar of the South Auckland Land District is hereby directed to make such entries in his Register, and to do all such other things as may be necessary to give effect to the provisions contained herein.

FIRST SCHEDULE

ALL that area in the South Auckland Land District, Taupo County, containing 189 acres, more or less, bounded by a line commencing at a point on the right bank of the Waikato River, situated in Block II, Tauhara Survey District in line with the generally north-eastern boundary of part Lot 1, D.P. 8698, and proceeding north-westerly along a right line to and along the last-mentioned boundary and its production to and generally north-westerly along the generally north-eastern boundary of part Nukuhau Block, as shown on D.P. 8698, to the easternmost corner of part Lot 5, D.P. 8698; thence north-westerly along the north-eastern boundary of that part Lot 5, aforesaid, and its production to the generally north-western side of Acacia Bay Road; thence generally north-easterly along that roadside to, and north-westerly along, the north-eastern boundary of part Rangatira 8A 5C 5 Block to its northernmost corner; thence generally easterly along the generally northern boundary of the Taupo Central Block and its production, crossing two intervening public roads, to the generally eastern side of State Highway No. 1; thence generally southerly along that side to, and generally south-westerly along the right bank of the Waikato River, aforesaid, being the boundary of Taupo Borough, as described in New Zealand Gazette, 1964, page 2272, to the point of commencement.

SECOND SCHEDULE

ALL that land containing 2 roods 16 perches, more or less, being Rangatira D 25, Blocks I and II, Acacia Bay Road, more particularly shown on M.L. Plan 18902.

County of Waihemo and Borough of Palmerston United Under Name of Waihemo County

ORDER IN COUNCIL

At the Government Buildings at Wellington this 20th day of February 1967

Present:

THE RIGHT HON. J. R. MARSHALL, PRESIDING IN COUNCIL

PURSUANT to the Local Government Commission Act 1961, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order shall take effect on 1 April 1967.

  2. The districts of the County of Waihemo and the Borough of Palmerston are hereby united, and the councils of the said county and the said borough are hereby dissolved.

  3. The united district shall be called the County of Waihemo (hereinafter called the “said county”).

  4. For representation purposes, the said county shall be divided into seven ridings, as follows:

(i) The Palmerston Riding, comprising the area contained in the district of the former Borough of Palmerston.

(ii) The Bushey Riding, comprising the Bushey Riding of the former County of Waihemo.

(iii) The Goodwood Riding, comprising the Goodwood Riding of the former County of Waihemo.

(iv) The Green Valley Riding, comprising the Green Valley Riding of the former County of Waihemo.

(v) The Macraes Riding, comprising the Macraes Riding of the former County of Waihemo.

(vi) The Dunback Riding, comprising the Dunback Riding of the former County of Waihemo.

(vii) The Blue Mountain Riding, comprising the Blue Mountain Riding of the former County of Waihemo.

  1. The Council of the said county shall consist of nine members, as follows:

For the Palmerston Riding ....... 2 members
For the Bushey Riding ........... 1 member
For the Goodwood Riding ......... 1 member
For the Green Valley Riding ..... 1 member
For the Macraes Riding .......... 2 members
For the Dunback Riding .......... 1 member
For the Blue Mountain Riding .... 1 member

  1. The first election of the members of the council of the said county shall be held on the day prescribed by law for the first triennial general elections of members of county councils to be held after the 1st day of April 1967.

  2. Until the members of the Council of the said county, elected at the said first election, shall come into office, the council of the said county shall consist of 10 members, being the seven members of the Council of the former County of Waihemo, and three of the members of the former Palmerston Borough Council, to be chosen by that council from among its members to represent the Palmerston Riding; and, for the purpose of making that choice, but for no other purpose, the members of the former Palmerston Borough Council shall, if necessary, continue in office after the 31st day of March 1967.

  3. The Palmerston Riding of the said county shall be a county town, having the name of Palmerston, and the provisions of the Counties Act 1956 shall apply in all respects as if the said county town had been constituted under section 417 of that Act.

  4. Until the date prescribed by law for the first triennial general election of members of county councils to be held after the 1st day of April 1967, the members of the Palmerston County Town Committee shall be the Mayor and Councillors of the former Borough of Palmerston.

  5. Except as otherwise provided herein, or in the Local Government Commission Act 1961, the provisions of the Counties Act 1956 shall, with the necessary modifications, and so far as they are applicable, apply to the union hereby effected, as if the Borough of Palmerston were a dependent town district to which section 28 of the Counties Act 1956 applies; and the District Land Registrar for the Otago Land Registration District is hereby directed to make such entries in his Register, and to do all such other things as may be necessary to give effect to the provisions of this clause.

  6. All the valuation rolls, electors lists, electors rolls, and rate books in force in the Borough of Palmerston on the 31st day of March 1967 shall continue in force, and be deemed to be the valuation rolls, electors lists, electors rolls, and rate books in force in the Palmerston Riding of the said county until new valuation rolls, electors lists, electors rolls, and rate books are made for the Palmerston Riding.

  7. The County Clerk of the former County of Waihemo shall be responsible for calling the first meeting of the council of the said county.

(i) the Moeraki Riding, comprising the Moeraki Riding of the former County of Waitaki, together with the area contained in the district of the former Borough of Hampden.

(ii) The Ahuriri Riding, comprising the Ahuriri Riding of the former County of Waitaki.

(iii) The Otekaike Riding, comprising the Otekaike Riding of the former County of Waitaki.

(iv) The Awamoko Riding, comprising the Awamoko Riding of the former County of Waitaki.

(v) The Papakaio Riding, comprising the Papakaio Riding of the former County of Waitaki.

(vi) The Waiareka Riding, comprising the Waiareka Riding of the former County of Waitaki.

(vii) The Incholme Riding, comprising the Incholme Riding of the former County of Waitaki.

(viii) The Kakanui Riding, comprising the Kakanui Riding of the former County of Waitaki.

(ix) The Otepopo Riding, comprising the Otepopo Riding of the former County of Waitaki.

  1. The council of the said county shall consist of nine members, as follows:

For the Moeraki Riding ........... 1 member
For the Ahuriri Riding ........... 1 member
For the Otekaike Riding ......... 1 member
For the Awamoko Riding .......... 1 member
