Declaring Land and Easements Over Land Taken for an Electric Power Substation in the City of Wellington

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, sufficient agreements to that effect having been entered into, the land first described in the Schedule hereto is hereby taken for an electric power substation and shall vest in the Mayor, Councillors, and Citizens of the City of Wellington from and after the 1st day of August 1966; and also hereby declares that easements in connection therewith, and forever appurtenant thereto, are hereby taken over the land secondly and thirdly described in the said Schedule hereto, vesting in the Mayor, Councillors, and Citizens of the City of Wellington the full and free rights, liberties, licences, and privileges in perpetuity, that is to say:

(a) The right to transmit electrical energy backwards and forwards under and along the land secondly described in the Schedule hereto.

(b) The right of ingress, egress, and regress on foot, with or without vehicles of all descriptions, either loaded or unloaded, by night as well as by day, over and along the lands secondly and thirdly described in the Schedule hereto.

(c) The right to enter upon all or any of the said lands secondly and thirdly described in the said Schedule hereto at all reasonable times by its servants, agents, and workmen, with all necessary tools, implements, plant, machinery, and vehicles for the purpose of laying, constructing, repairing, renewing, and maintaining, at such depths as shall be necessary, all cables and fittings as shall be required for the unimpeded transmission of electrical energy as aforesaid.

(d) The right to dig up and break the surface of the said lands secondly and thirdly described in the said Schedule hereto, or any parts thereof, and generally to do and perform all acts and things as may be necessary or proper, including reinstatement of the said lands, for any of the purposes hereinbefore mentioned.

Provided however that the registered owner of the said lands secondly and thirdly described in the said Schedule shall be given reasonable notice before any work hereunder is commenced, and that when any such work is being carried out there shall be caused as little interference as possible to the said registered owner’s access to Owen Street.

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken for road from and after the 1st day of August 1966.

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, sufficient agreements to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for road, and the land described in the Second Schedule hereto is hereby taken for the use, convenience, or enjoyment of a road: and the leasehold estate in the land described in the Third Schedule hereto, held by Gordon Ernest Jarrett, sharemilker, Waitoa, and Esma May Jarrett, his wife, as tenants-in-common, in equal shares, under and by virtue of Crown lease, volume 735, folio 83, South Auckland Land Registry; and the leasehold estate in the land described in the Fourth Schedule hereto, held by Cyril Thomas George Pittams, of Te Rau-a-moa, farmer, under and by virtue of Crown lease, Volume 846, folio 170, South Auckland Land Registry; and the leasehold estate in the land described in the Fifth Schedule hereto, held by Lewis Godfrey Larsen, of Tokoroa, carpenter, under and by virtue of Crown lease, Volume 1006, folio 163, South Auckland Land Registry, are hereby taken for the purposes of a road from and after the 1st day of August 1966.
