Appointing a Commission to Inquire into Administration of Security Service So Far as it Relates to Attendance of Officers Thereof at a University

ORDER IN COUNCIL
To all to whom these presents shall come, and to:
THE HONOURABLE SIR JAMES DOUGLAS HUTCHISON, a Judge of the Supreme Court of New Zealand.
GREETING:
WHEREAS it is deemed expedient that inquiry should be made into the administration of the Security Service with respect to the attendance of officers thereof at a university, and, in particular, with respect to the attendance of David Godfrey, an officer of that Service, at the University of Auckland, and matters incidental thereto:
Now therefore, pursuant to the Commissions of Inquiry Act 1908, I, Brigadier Sir Bernard Edward Fergusson, the Governor-General of New Zealand, acting by and with the advice and consent of the Executive Council, hereby appoint you, the said the Honourable Sir James Douglas Hutchison, to be a Commission to inquire into and report upon the following matters:
-
The administration of the Security Service in so far as it relates to—
(a) Permitting, authorising, or requiring the attendance at a university of its officers, and in particular, the attendance at the University of Auckland of David Godfrey, an officer of the said Security Service:
(b) The duties, if any, that the said David Godfrey was required to perform or did perform as an officer of the Security Service while attending at classes, lectures, tutorials, or seminars:
(c) The duties, if any, that the said David Godfrey was otherwise required to perform or did perform as an officer of the Security Service connected with or relating to the said university: -
The authority of the said University of Auckland, and the exercise of that authority, relating to the suspension, limitation, or prohibition of attendance at the said university, or any part of its activities, of the said David Godfrey, a duly enrolled student, and the reasons for and propriety of such suspension, limitation, or prohibition, including, but without limiting the generality of the foregoing provisions,—
(a) The conduct of staff and students arising out of the attendance at the said University of the said David Godfrey;
(b) The disturbance in and around the Political Studies Department on the 31st day of May 1966; and
(c) Whether or not the said David Godfrey had been conspired against or victimised by either university staff or students: -
The conduct of David Godfrey as an officer of the Security Service arising out of or in connection with his attendance at the said University of Auckland:

The conduct of the Police at the aforesaid disturbance in and around the Political Studies Department of the said University of Auckland on the 31st day of May 1966.
And for the better enabling you to carry these presents into effect you are hereby authorised and empowered to make and conduct any inquiry under these presents, in accordance with the Commissions of Inquiry Act 1908, at such times and places as you deem expedient, with power to adjourn from time to time and place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or place to place:
And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose, save to me in pursuance of these presents or by my direction, the contents or purport of any report so made or to be made by you or any evidence or information obtained by you in exercise of the powers hereby conferred upon you except such evidence or information as is received in the course of a sitting open to the public:
And it is hereby further declared that you have liberty to report your proceedings and recommendations under this Commission from time to time if you shall judge it expedient so to do:
And, using all due diligence, you are required to report to me in writing under your hand not later than the 15th day of August 1966 your finding and opinion on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof.
