THE CHARITABLE TRUSTS ACT 1957

NOTICE OF APPLICATION FOR APPROVAL OF SCHEME

In the Supreme Court of New Zealand
Otago and Southland District
(Dunedin Registry)

IN the matter of the Charitable Trusts Act 1957, and in the
matter of the Judicature Act 1908, and in the matter of a
certain trust deed hearing dated the 2nd day of September
1907 relating to the Hocken Collection, notice is hereby given
that the University of Otago has made application to the
Supreme Court of New Zealand, Otago and Southland Dis-
trict, Dunedin Registry, for an order adopting a report and
approving a scheme, prepared by the University under the
Charitable Trusts Act 1957, whereby the trust deed under
which the university holds the Hocken Collection is varied to
enable the university to remove the collection, or any part
or parts thereof, from the building in which it is housed
pursuant to the said trust deed and to house the same in a
suitable building or buildings under the control of the univer-
sity, to enable items of the collection to leave the building in
which they are housed for photographing or other form of
copying or for cleaning or repair or on short term loan to
libraries, museums, art galleries, and other institutions and
to enable duplicate items to be disposed of upon the grounds
that the administration of the collection and the carrying out
of the trusts contained in the said trust deed would be facilitated
by extending and varying the powers of the university under
the said trust deed in manner set out in the said scheme, and
notice is also given that the said scheme has been submitted
to and approved by the Honourable the Attorney-General for
New Zealand and that a copy of such scheme, and of the
Honourable the Attorney-General’s report thereon, has been
filed in the office of the Registrar of the Supreme Court at
Dunedin and that they are both open for public inspection
without payment of fee or charge, and notice is also given
that the said application will be heard in the Supreme Court,
at Dunedin, on Monday, the 30th day of May 1966, at 10 a.m.,
or so soon thereafter as Counsel may be heard, and that any
person desiring to oppose the said scheme shall give written
notice of his intention to do so to the Registrar and the
University of Otago and the Honourable the Attorney-General
not less than seven clear days before that date.

Dated this 20th day of April 1966.
