PURSUANT to section 165 of the Harbours Act 1950, the Minister of Marine hereby gives notice that he approves the Thames County Council General Bylaws, special order, made by the Thames County Council, on 22 April 1965.

Licensing Kerridge Odeon Corporation Ltd. to Use and Occupy a Part of the Foreshore and Bed of the Sea at Pakatoa Island as a Site for a Wharf
PURSUANT to the Harbours Act 1950, the Minister of Marine hereby licenses and permits Kerridge Odeon Corporation Ltd. (hereinafter called the licensee, which term shall include its successors or assigns unless the context requires a different construction) to use and occupy a part of the foreshore and bed of the sea at Pakatoa Island, as shown on plan marked M.D. 7572 and deposited in the office of the Marine Department at Wellington, for the purpose of maintaining thereon a wharf as shown on the said plan, such licence to be held and enjoyed by the licensee upon and subject to the terms and conditions set forth in the Schedule hereto.
SCHEDULE
CONDITIONS

This licence is subject to the Foreshore Licence Regulations 1960, and the provisions of those regulations shall, so far as applicable, apply hereto.

The term of the licence shall be 14 years from the 1st day of April 1965.

The premium payable by the licensee shall be £3 and the annual sum so payable £10.

Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963 and in the matter of an application by the Secretary for Justice in respect of a book Can I get there by Candlelight by Julius Horwitz, published by Andre Deutsch Ltd., of 105 Great Russell Street, London.
DECISION OF THE TRIBUNAL
THE Tribunal has considered the application of the Secretary for Justice for a decision in respect of the above-named book—whether it is indecent or not, or alternatively a decision as to its classification.
No submissions were offered on behalf of the Secretary for Justice; we were informed that the book had been submitted because of a complaint received from a reader. The publisher, through its representative in New Zealand, contended that the action, even if justified, was belated since the book had been selling without complaint for many months and had reached the end of its normal “sales life” (in fact six copies for the use of the Tribunal had to be obtained from England); secondly, that the book was a truthful picture of the relations which prevailed between American soldiers and English people during wartime in England; and that it had some literary merit.
The story tells of an American airman stationed in England and of his experiences—sexual and otherwise—including an account of one occasion in an American camp which might fairly be termed an orgy. Having regard to the indulgence in sexual activities prevalent at the time and though we appreciate that some readers might find some of the descriptions objectionable, we think the story may nevertheless be a fair picture of what went on and that it presents an aspect of life during wartime too often glossed over.
We do not feel justified in classing the book as indecent and hold accordingly that the book is not indecent within the meaning of the statute.

Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963 and in the matter of an application by Collins Bros. and Co. Ltd., of Auckland, in respect of a paperback edition of Mandingo by Kyle Onstott.
DECISION OF THE TRIBUNAL
THE Tribunal has considered the application of Collins Bros. and Co. Ltd.—made with the consent of the Minister of Justice—for a decision in respect of the above-named book—whether it is indecent or not, or alternatively a decision as to its classification.
The book had previously been published in a hard-back edition though that edition does not appear to have circulated in New Zealand. There have been further publications by the author (on sale in New Zealand) which deal, as does Mandingo, with slavery as it existed in the nineteenth century in the South of the United States of America. The deplorable conditions under which Negro men and women lived are described in detail, and there are accounts of revolting cruelty.
But apparently it is a fair picture of the life of the times when, the cotton crops having in some areas failed, Negroes were bred like cattle (and treated worse) for the market. The books shows up the ignorance and inhumanity of the whites no less than the consequent degradation of the Negro. It is obviously relevant as background to present problems of the Negroes in the United States. The story is told with a laconic detached realism that gives it more the character of a documentary than a mere exploiting of horror. We determine accordingly that the book is not indecent within the meaning of the Act.

Decision of the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963 and in the matter of an application by Tracy Hammonds, of Invercargill, in respect of six issues of a magazine Playboy for August, September, October, November, and December 1964 and January 1965.
DECISION OF THE TRIBUNAL
THE applicant obtained the permission of the Minister of Justice to submit to the Tribunal the six issues described above. No submissions were made on behalf of the Secretary for Justice. The applicant forwarded in writing his contentions regarding the publication. These have been considered and the six issues of the magazine examined.
