Declaring Leasehold and Subleasehold Estates in Land Taken for a University in the City of Auckland

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the leasehold estate in the land described in the First and Second Schedules hereto, held from Her Majesty the Queen for a university by Armadale Chambers Ltd. and by Ethel Mills under and by virtue of leases No. 247 and 246, respectively, North Auckland Land Registry, and the subleasehold estate in the land described in the Second Schedule hereto, held from Ethel Mills by Armadale Chambers Ltd. as sublessee under and by virtue of lease No. 2458 of part lease No. 246, North Auckland Land Registry, are hereby taken for a university from and after the 30th day of August 1965.

Declaring an Easement Over Land Taken, Subject to Certain Rights, for the Purposes of a Maori School in Block III, Mangakahia Survey District

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, an easement over the land described in the First Schedule hereto is hereby taken for the purposes of a Maori school from and after the 30th day of August 1965 vesting in Her Majesty the Queen first, full and free right, liberty, licence, and authority in perpetuity to convey water along, under, and over the said land and for that purpose to lay, construct, place reconstruct, cleanse, repair, and maintain a line of water pipes along, under, or over the said land and to construct, use, and maintain a pump house thereon, and, secondly, full and free liberty, right, licence, and authority in perpetuity for Her Majesty’s servants, agents, and workmen from time to time and at all times hereafter to go, pass, or repass, with or without horses and vehicles, over the land described in the First Schedule hereto for the purposes of construction, maintenance, and repair of the aforesaid pipeline and pump house, such easement to be held appurtenant to the land described in the Second Schedule hereto, subject for so long as the Crown shall continue to maintain and repair the said pipeline to the right of Ben Armstrong or the owners for the time being of Kaikou No. 3, Lot 3B, Block III, Mangakahia Survey District, at any time during the normal working hours of the pump installed in the pump house erected on the land described in the First Schedule to draw and take water from a stand pipe installed by Her Majesty the Queen on the line of pipes laid along, under, or over the land described in the said First Schedule.
