THE CHARITABLE TRUSTS ACT 1957
NOTICE OF JUDGMENT REFUSING AN ORDER
IN the matter of a motion for an order approving a scheme filed under Part III of the Charitable Trusts Act 1957, whereas, by virtue of a will dated 25 January 1938, Arthur Powys Whatman gave, devised, and bequeathed a property known as “Panama” to the Wairarapa Hospital Board upon trust to use the same as a convalescent or rest home for the sick, aged, or needy and for persons convalescing or recovering from sickness or ill health; and whereas the Wairarapa Hospital Board was desirous of transferring the said property to the Wellington Presbyterian Social Services Association Incorporated, pursuant to a scheme prepared and submitted under Part III of the above Act; and whereas, pursuant to section 53 of the above Act, the Wairarapa Hospital Board applied to the Supreme Court at Masterton for an order approving the said scheme; and whereas the motion was heard in the Supreme Court at Wellington on Friday the 25th day of June 1965, notice is hereby given, pursuant to section 54 of the above Act, that on the 16th day of July 1965 the Court gave judgment refusing the said order on the following grounds:
(a) The proposed scheme involves the selling of the “Panama” property contrary to the wishes of the deceased;
(b) It is reasonably practicable to retain “Panama” and to use it for the benefit of the aged and needy; and
(c) The retention of “Panama” and its use for the above-mentioned charitable purposes is more in accord with the intention of the deceased than the proposed scheme.
