ALL that piece of land containing 2 roods 16 perches situated
in Block VII, Mahurangi Survey District, Town District of
Warkworth, North Auckland R.D., and being part Allotment
67, Parish of Mahurangi; as the same is more particularly
delineated on the plan marked M.O.W. 19276 (S.O. 44728)
deposited in the office of the Minister of Works at Wellington,
and thereon coloured yellow.

Land and an Easement Over Land Taken, Subject to Certain
Rights, for a Post Office in the Borough of Onehunga
PURSUANT to section 32 of the Public Works Act 1928, the
Minister of Works hereby declares that, a sufficient agreement
to that effect having been entered into, the land described in
the First Schedule hereto is hereby taken for a post office
and that an easement of right of way is hereby taken for
post office purposes over the land described in the Second
and Third Schedules hereto, vesting in Her Majesty the
Queen the full and free right, liberty, licence, and authority
in perpetuity for herself, her servants, agents, workmen,
licensees, and invitees from time to time and all times by
day and by night to go, pass, and repass, with or without
horses and domestic animals of any kind, and with or with-
out carriages, vehicles, motor vehicles, loaded or unloaded,
machinery and implements of whatsoever kind over and along
the said land described in the Second and Third Schedules,
and to maintain, repair, and keep open the said right of way;
and I also declare that the aforesaid easement shall be held
forever appurtenant to the land described in the First Schedule
hereto from and after the 15th day of April 1965.

District
PURSUANT to section 32 of the Public Works Act 1928, the
Minister of Works hereby declares that, a sufficient agreement
to that effect having been entered into, the land described in
the Schedule hereto is hereby taken for Post Office purposes
(V.H.F. Repeater station site) from and after the 15th day
of April 1965,

ALL that piece of land containing 2 roods 14·5 perches
situated in Block III, Clifford Bay Survey District, being part
land shown on D.P. 299, being also part Section 7, Block I,
Wakefield Downs Registration District; as the same is more
particularly delineated on the plan marked M.O.W. 19309
(S.O. 4684) deposited in the office of the Minister of Works
at Wellington, and thereon coloured blue.

Declaring a Leasehold Estate in Land Taken for Broadcasting
Purposes in Block VIII, Horohoro Survey District, and
Block V, Tarawera Survey District, Rotorua County
PURSUANT to section 32 of the Public Works Act 1928, the
Minister of Works hereby declares that, a sufficient agreement
to that effect having been entered into, the leasehold estate
set forth in the First Schedule hereto and the land described
in the Second Schedule hereto is hereby taken for broad-
casting purposes (transmitting station) and shall vest in the
New Zealand Broadcasting Corporation from and after
the 15th day of April 1965.
FIRST SCHEDULE
DESCRIPTION OF LEASEHOLD ESTATE TAKEN
-
Definitions: In this Schedule:
(a) The term “Lessor” shall mean the registered proprietors
of the land described in the Second Schedule hereto
and their respective successors and assigns.
(b) The term “Lessee” shall mean the New Zealand
Broadcasting Corporation and its successors and
permitted assigns. -
The lease shall be for a term of 21 years commencing
on the date hereinbefore mentioned. -
The rental shall be £100 per annum for the first 10 years
from the date hereinbefore mentioned and thereafter at such
rate as may be agreed upon between The Proprietors of Ngati
Whakaue Tribal Lands (Incorp) (as agent for the Lessor)
and the Lessee or failing agreement as shall be determined by
the Land Valuation Court in accordance with the provisions
of the Public Works Act 1928 but shall not in any case be
less than £100 per annum. Any such rental shall be payable
half-yearly in advance and shall be paid to The Proprietors
of Ngati Whakaue Tribal Lands (Incorp) whose receipt shall
be a good discharge to the Lessee. -
(a) The Lessee shall duly and punctually pay all rates
and taxes and other outgoings in relation to the said land.
(b) The Lessee will comply with all Acts, bylaws, and
regulations for the time being in force in the district in which
the said land is situate in so far as they relate to the said
land and in so far as the Lessee may be bound thereby.
(c) The Lessee shall have the right to erect and maintain
on the said land such buildings and structures as the Lessee
shall deem necessary and shall have the right at any time to
remove from the said land any such buildings or structures.
No building or structure shall be deemed to be a fixture for
any purpose whatever.
(d) The Lessee shall not, without the consent in writing of
The Proprietors of Ngati Whakaue Tribal Lands (Incorp)
assign, transfer, underlet, or in any way part with possession
of the said land, provided that such consent shall not be
unreasonably withheld.
(e) The Lessee shall have the right to a renewal of this
lease for a further term of 10 years from the expiration of the
term hereby created at a rental to be agreed upon between
the Lessee and The Proprietors of Ngati Whakaue Tribal
Lands (Incorp) or failing agreement by the Land Valuation
Court in accordance with the Public Works Act 1928 and with
the exception of this present provision for renewal upon and
subject to the same terms and conditions herein contained.
Provided that the Lessee shall give The Proprietors of Ngati
Whakaue Tribal Lands (Incorp) three months written notice
of the Lessee’s desire to obtain such renewal.

SOUTH AUCKLAND LAND DISTRICT
ALL those pieces of land described as follows:

as above mentioned.
