press and the advertisements appear to be intended to
attract homosexuals or to promote or encourage homo-
sexuality. We had evidence that such magazines were often
to be found in the possession of known homosexuals and that
they had on occasions been used by men to inveigle younger
men into homosexual practices. We accept Mr Barnard’s
statement that he was quite unaware that the magazines were
of this character. He stated that he had not scrutinised
them personally and that no member of his staff of 10
(including some women) had ever made any adverse comment.
Nevertheless we regard them—except for one—as so objection-
able as to warrant condemnation as indecent and injurious
to the public welfare. We have in previous decisions referred
to the difficulty of assessing the standard of the community
but—since in our view four of these magazines are designed
to appeal to or to encourage homosexuality, which in New
Zealand is a criminal offence, we are bound to hold them
indecent with the meaning of the Statute. We except the
magazine Tomorrow’s Man which is concerned mainly with
body building and physique and has not features that the
others display.

Accordingly we classify each of the magazines other than
Tomorrow’s Man as indecent and so report.

At the hearing we made an interim order forbidding the
publication of the names of the magazines; this we now
discharge.

We make no order as to costs.

In conclusion we desire to state that we recognise that
this decision may by inference be considered applicable to
future issues of the magazines which we have held to be
indecent unless their character is significantly modified in the
light of this decision. That is, of course, a question that
may or may not hereafter be pursued. Meanwhile the tribunal
bases its decision upon the particular issues which it had
before it.

Industrial Conciliation and Arbitration Act 1954—Proposed
Cancellation of Registration of Industrial Union

Pursuant to section 85 of the Industrial Conciliation and
Arbitration Act 1954, it is hereby notified that the registration
of the Wellington Metal Workers’ Assistants Industrial Union
of Workers, Registered No. 930, situated at Room 15, Trades
Hall, Wellington, will, unless cause to the contrary is shown,
be cancelled on the expiration of six weeks from the
date of the publication of this notice in the Gazette.

Assignment of Foreshore Licence

Pursuant to the Harbours Act 1950, the Secretary for Marine
hereby gives notice that the licence granted to James Harold
Young on the 19th day of January 1960* is hereby assigned
to John Alexander King Spicer and Clarence Russell Pollard.
