THE CHARITABLE TRUSTS ACT 1957
NOTICE OF APPLICATION TO VARY SCHEME
IN the matter of Part III of the Charitable Trusts Act 1957
and in the matter of the Pomona Hall established by Deed
of Trust by John Charles Boord, deceased, notice is hereby
given that the trustees of the above trust created by the late
John Charles Boord, on 17 August 1876, to provide a public
hall between Taupaki and Kumeu, known as Pomona Hall,
will apply to the Supreme Court, at Auckland, at 10 a.m.,
on the 8th day of February 1965, to vary the purposes of the
said trust by selling the said property and dividing the net
proceeds (after deduction of expenses) between the public
primary schools at Taupaki and Huapai by payment to the
respective school committees, upon the grounds that it is
impossible, impracticable, or inexpedient to carry out the
original purposes of a community hall because of the subsequent provision of alternative facilities closer to the
centres of population in the district.
And notice is further given that full particulars of the
matter appear in the application by way of Origination
Summons, the scheme lodged by the trustees and the report
of the Attorney-General and other papers under M. No.
458A/64, which may be inspected, free of charge, at the
Auckland Registry of the Supreme Court, Waterloo Quadrant,
Auckland, during normal court office hours except during the
court vacation when restricted hours apply.
And notice is further given that any person desiring to
oppose the scheme may do so and is required to give written
notice of such intention to the Registrar of the Supreme Court,
at Auckland, to the Attorney-General, and to the Trustees.
F. G. MASSEY, Solicitor for the Trustees.
This notice is given by the Trustees, whose address for
service is at the offices of Messrs Earl, Kent, Massey, Palmer,
and Hamer, New Zealand Insurance Building, 103–105 Queen
Street, Auckland C.1.
