DONALD GRANT BALLANTYNE shall not be called upon to contribute towards the cost of erection or maintenance of any fence between the land described in the First and Second Schedules hereto and any adjoining land the property of or occupied by the said Donald Grant Ballantyne, but this proviso shall not enure to the benefit of any subsequent purchaser of any such adjoining land.

Declaring an Easement Over Land Taken for Teachers' Residences in Block VII, Waiwera Survey District

PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, an easement (right of way) over the land described in the First Schedule hereto is hereby taken for teachers' residences, vesting in Her Majesty the Queen the full and free right, liberty, and licence in perpetuity to construct and use a right of way, with the right for Her Majesty the Queen and her tenants, agents, servants, workmen, invitees, and licensees (in common with any other persons from time to time lawfully using the same) from time to time and at all times by night as well as by day to go, pass, or repass with or without vehicles, motor vehicles, horses, or domestic animals of any kind and with or without carriages and with or without implements of any kind, over the said land and to maintain, repair, and keep open the said right of way, such easement to be held appurtenant to the land described in the Second Schedule hereto from and after the 5th day of October 1964.

FIRST SCHEDULE

ALL that piece of land containing 10·7 perches situated in Block VII, Waiwera Survey District, North Auckland R.D., and being part Lot 3, D.P. 41186; as the same is more particularly delineated on the plan marked M.O.W. 18761 (S.O. 44474) deposited in the office of the Minister of Works at Wellington, and thereon coloured blue.

SECOND SCHEDULE

NORTH AUCKLAND LAND DISTRICT
