ALL that piece of land containing 5·7 perches situated in the Borough of Oamaru, Otago R.D., and being part Section 14, Block I, Oamaru Survey District; as the same is more particularly delineated on the plan marked M.O.W. 18708 (S.O. 13478) deposited in the office of the Minister of Works at Wellington, and thereon coloured blue.

Dated at Wellington this 19th day of August 1964.

Declaring Land and an Easement Over Land Taken for a Hospital in the City of Tauranga


PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works, hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby taken for a hospital and the sewerage easement described in the Second Schedule hereto is hereby taken for a hospital over the land described in the Third Schedule hereto and that both the land and easement shall vest in the Tauranga Hospital Board from and after the 21st day of September 1964.


FIRST SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Land Taken for a Hospital

ALL those pieces of land, situated in the City of Tauranga, described as follows:

A. R. P. Being
0 0 22 Part old bed of Kopurererua Stream; coloured sepia on plan.
3 3 33 Part Allotment 523, Te Papa Parish; coloured yellow, edged yellow on plan.

As the same are more particularly delineated on the plan marked M.O.W. 18745 (S.O. 38232) deposited in the office of the Minister of Works at Wellington, and thereon coloured as above mentioned.


SECOND SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Description of Easement

  1. The full, free, and uninterrupted right, privilege, and authority for the Tauranga Hospital Board (hereinafter referred to as “the Board”) for all time hereafter to carry and convey sewage through and under those pieces of land described in the Third Schedule hereto (hereinafter referred to as “the said easement”) and discharge the same beyond the said easement and for such purpose from time to time to dig up to any depth and again fill in the soil of the said easement and to lay down, construct, erect, and make in, through, or under the said easement pipes and/or concrete conduits of such size as the Board shall think fit with such manholes, valves, and surface boxes as the Board shall think fit and from time to time to alter, repair, and maintain the said pipes, and/or concrete conduits, manholes, valves, and surface boxes and to inspect, cleanse, extend, and remove and enlarge the same and to have to the same for any such purpose access to and from the said easement across the remainder of the servient tenement by the most convenient and suitable route and also full power and authority for the Board its surveyors, engineers, workmen, agents, and servants with or without vehicles and machinery from time to time and at all times to enter and remain for any of the purposes aforesaid upon such portions of the servient tenement as shall be necessary for such purposes and generally to do and perform all such acts and things in or about the servient tenement as may be necessary or proper for or in relation to any of the purposes aforesaid.

  2. The Board shall and will at all times repair and maintain all such pipes and/or concrete conduits as may be laid down, constructed, or erected in or under the said easement in pursuance of these presents in a good and efficient state of repair for the purposes for which the same are designed and will prevent the same from becoming a nuisance.

  3. In the event of the Board entering into and upon the servient tenement for the purpose of repairing the present pipes or concrete conduits or for repairing and efficiently maintaining such pipes or concrete conduits or any of them and for any of the purposes aforesaid the Board shall and will carry out and complete the same with as little disturbance to the surface of the servient tenement as possible and shall and will immediately upon the completion of any such work thereon restore the surface of the said servient tenement as nearly as possible to its original condition.

  4. The Board will from time to time repair and make good all damage to fences, gates, or drains in, upon, or around the said lands caused by the carrying out by the Board of any of the works hereinbefore mentioned.

  5. No buildings, erections, or fences shall be placed on the said easement and the registered proprietor for the time being of the servient tenement shall not at any time hereafter do, permit, or suffer any act whereby the rights, powers, licenses, and liberties hereby taken may be interfered with or affected. But this provision shall not affect any fence already erected upon the said parcel of land.

  6. Nothing herein contained or implied shall be deemed to compel the Board to conduct sewage through the said pipes and/or concrete conduits and the Board may discontinue such drainage at will.


THIRD SCHEDULE
SOUTH AUCKLAND LAND DISTRICT
Land Over Which Easement is Taken

ALL those pieces of land situated in the City of Tauranga, described as follows:

A. R. P. Being
0 1 19·6 Part Allotment 523, Te Papa Parish; coloured yellow on plan.
0 1 7 Section 61, Suburbs of Tauranga; coloured sepia on plan.

As the same are more particularly delineated on the plan marked M.O.W. 18745 (S.O. 38232) deposited in the Office of the Minister of Works at Wellington, and thereon coloured as above mentioned.
