  1. Returns are required to be furnished—
    (a) Not later than 7 June 1964 where—
    (i) The taxpayer is not authorised to furnish the return under section 8 of the Land and Income Tax Act 1954, for an accounting year ending with a balance date other than the 31st day of March 1964; and
    (ii) The taxpayer did not derive any assessable income in the income year ended 31 March 1964, except income from employment.
    (b) Where paragraph (a) does not apply—
    (i) Not later than 7 August 1964 where the returns are for an accounting year ending with any day in the period 1 October 1963 to 7 June 1964, both days inclusive;
    (ii) Within two months after the end of the accounting year where the returns are for an accounting year ending with any day in the period 8 June 1964 to 30 September 1964, both days inclusive.
  2. All return forms are available at all district offices of the Taxes Division, Inland Revenue Department, and all forms other than interim return forms and those for companies are also available at all post offices.
  3. Any person (including a company) failing to furnish a return within the prescribed time is liable to a fine not exceeding £100 and not less than £2.

Price Order No. 1940 (Raw Tobacco Leaf)

PURSUANT to the Control of Prices Act 1947, the Price Tribunal hereby makes the following price order:

  1. This order may be cited as Price Order No. 1940 and shall come into force on the 8th day of May 1964.
  2. In this order—
    “Flue-cured leaf” means leaf that has been treated in the kiln for at least three successive days immediately after picking for the purpose of yellowing, fixing colour, drying, and drying mid-ribs;
    “Air-dried leaf” means leaf other than flue-cured leaf;
    “Raw tobacco” means unmanufactured tobacco and includes the leaves and stems of the tobacco plant before they have passed through any process of manufacture other than curing;
    “Sale” includes a contract for sale, agreement to sell, and offer for sale; “purchase” includes a contract for purchase, agreement to purchase, and offer to purchase; and “sale” and “purchase” include barter and exchange.

APPLICATION OF THIS ORDER

  1. This order applies with respect to all raw tobacco leaf grown in New Zealand during the 1963–64 season: Provided that the Tribunal may, in any case where it considers it proper to do so and subject to such conditions (if any) as it thinks fit, exempt any such tobacco from the operation of this order.

FIXING AVERAGE PRICES OF RAW TOBACCO LEAF TO WHICH THIS ORDER APPLIES

  1. (1) The average price to be paid by any tobacco manufacturer for raw tobacco leaf to which this order applies shall be not less than—
    (a) For flue-cured leaf: 4s. 5d. per pound.
    (b) For air-dried leaf: 4s. 0½d. per pound.
    (2) For the purpose of this clause the weight of any raw tobacco leaf shall be deemed to be its weight at the time and place of delivery by the grower to the manufacturer or to his agent in the district in which it is grown: Provided that in any case where the grower and the manufacturer or his agent agree that the moisture content of the leaf in any lot of tobacco is excessive, then, for the purposes of calculating the value of the lot, the weight of the lot shall be deemed to be reduced by a reasonable amount to make allowance for the excessive moisture.
  2. No raw tobacco shall be sold by the grower thereof or purchased from him at less than 2s. per pound free on board ship Motueka or Nelson in the case of tobacco grown in the Nelson Provincial District, and in the case of tobacco grown in any other district at less than 2s. per pound free on board ship or free on rail at the port or railway station which is nearest to the place at which such tobacco is grown.
  3. No raw tobacco shall be sold by any person other than the grower thereof or purchased from such other person at less than 2s. per pound free on board ship or free on rail at the port or railway station which is nearest to the place at which such tobacco is, at the time of sale thereof, being held or stored.
  4. Notwithstanding anything in the provisions of clauses 5 and 6 hereof, the Tribunal may, in any case where it considers it proper so to do, authorise the sale and purchase of tobacco at a price less than the price fixed by either of those clauses.

Releasing Land From the Provisions of Part XXIV of the Maori Affairs Act 1953 (Hauraki Development Scheme)

PURSUANT to section 332 of the Maori Affairs Act 1953, the Board of Maori Affairs hereby declares that on the date of the publication of this notice in the Gazette the land described in the Schedule hereto shall cease to be subject to the provisions of Part XXIV of the Maori Affairs Act 1953, the said land being so subject by virtue of a notice dated 6 December 1940, published in the Gazette, 12 December 1940, Volume III, page 3704, and registered as No. K. 26316.
