Appointing a Commission to Inquire Into Alleged Nuisances
in Auckland Metropolitan Drainage District

To ALL TO WHOM THESE PRESENTS SHALL COME, AND TO:
Frank Felix Reid, Esquire, C.B.E., of Christchurch, Retired
Stipendiary Magistrate;
Walter Edwin Bate, Esquire, O.B.E., of Hastings, Barrister
and Solicitor; and
Francis Malcolm Corkill, Esquire, of Invercargill,
Engineer:
GREETING:
WHEREAS it has been alleged that arising out of the exercise
by the Auckland Metropolitan Drainage Board of certain
powers conferred on it by the Auckland Metropolitan Drain-
age Act 1960 in relation to the treatment of and dealing
with sewage, refuse, and other matter, nuisances have been
created due to the escape of swarms of midges and of offensive
smells, and questions have arisen as to the creation, existence,
and abatement of the nuisances so alleged, and it is desirable
that inquiry should be made into the cause or causes of the
nuisances so alleged and into possible methods of abatement
and into the question whether any, and, if so what, legislation
is necessary or expedient in order to direct, authorise, or
obtain such abatement:
Now therefore, pursuant to the Commissions of Inquiry Act
1908, I, Brigadier Sir Bernard Fergusson, the Governor-General
of New Zealand, acting by and with the advice and consent
of the Executive Council, hereby appoint you, the said Frank
Felix Reid, Walter Edwin Bate, and Francis Malcolm Corkill,
to be a Commission to inquire into and report upon the
following matters:
(1) The cause of the said swarms of midges and the said
offensive smells.
(2) Whether there is any practicable method of extinguish-
ing or reducing the said swarms of midges and the
said offensive smells.
(3) The necessity or desirability of legislation being enacted,
whether by way of amendment to the Auckland
Metropolitan Drainage Act 1960 or otherwise, to
give effect to any recommendation that may be
made by you.
(4) And, generally, upon any other matters arising out of
the premises which may come to your notice in the
course of your inquiries and which you may consider
should be investigated in connection therewith, and
upon any matters affecting the premises which you
consider should be brought to the attention of
the Government.
And, with the like advice and consent, I do hereby appoint
you, the said Frank Felix Reid, to be Chairman of the said
Commission:
And for the better enabling you to carry these presents into
effect you are hereby authorised and empowered to make and
conduct any inquiry under these presents at such times and
places as you deem expedient, with power to adjourn from
time to time and place to place as you think fit, and so that
these presents shall continue in force and the inquiry may at
any time and place be resumed although not regularly
adjourned from time to time or from place to place:
And you are hereby strictly charged and directed that
you shall not at any time publish or otherwise disclose, save
to me in pursuance of these presents or by my direction,
the contents or purport of any report so made or to be made
by you or any evidence or information obtained by you in
the exercise of the powers hereby conferred upon you
except such evidence or information as is received in the
course of a sitting open to the public:
And it is hereby declared that the powers hereby conferred
shall be exercisable notwithstanding the absence at any time
of any one of the members hereby appointed so long as the
Chairman or a member deputed by the Chairman to act in his
stead and one other member be present and concur in the
exercise of such powers:
And it is hereby further declared that you have liberty to
report your proceedings and findings under this Commission
from time to time if you judge it expedient so to do:
And, using all due diligence, you are required to report
to me in writing under your hands not later than the 30th
day of May 1964 your findings and opinions on the matters
aforesaid, together with such recommendations as you think
fit to make in respect thereof.
Given in Executive Council under the hand of His
Excellency the Governor-General this 20th day of
December 1963.

PURSUANT to the Electoral Act 1956, I have received returns
to the Writs issued on 30 October 1963 for the election of
members of Parliament to serve in the House of Representa-
tives for the electoral districts hereinafter specified, and by
the endorsement on those writs it appears that the under-
mentioned persons have been duly elected members for the
said districts, viz:

Auckland Central: Norman Vazey Douglas.
Avon: John Mathison.
Awarua: Gordon Glendinning Grieve.
Bay of Plenty: Percy Benjamin Allen.
Buller: Wallace Edward Rowling.
