Order No. 1 (1963) of the Trade Practices and Prices Commission In the matter of the Trade Practices Act 1958 and in the matter of an inquiry concerning the distribution of bread and small goods by the Masterton members of the Wairarapa Branch of the Manawatu, Southern Hawke’s Bay, and Wairarapa Master Bakers’ Association. WHEREAS the Trade Practices and Prices Commission has, pursuant to section 18 of the Trade Practices Act 1958, conducted an inquiry into an agreement or arrangement between the Masterton members of the Wairarapa Branch of the Manawatu, Southern Hawke’s Bay, and Wairarapa Master Bakers’ Association (hereinafter referred to as “the Association”). And whereas, prior to the said inquiry, the Examiner of Trade Practices and Prices presented to the Commission a report pursuant to section 17 of the Trade Practices Act 1958 and a reply thereto was filed by the Masterton members of the Association. And whereas in the report of the Examiner it was alleged that the Masterton members of the Association were parties to an agreement or arrangement whereby each undertook: (a) That he would not deliver bread to a shop or depot already being supplied by a fellow baker; (b) That returns of bread would not be accepted; (c) That no price cutting in respect of bread or small goods would take place; and (d) That any member desiring to dispose of his bakery would give the first opportunity to purchase to the other Masterton members of the Association. And whereas in their reply the Masterton members of the Association admitted the existence of the said agreements or arrangements and that they were being closely observed by all the said members, but denied that the said agreements or arrangements were trade practices within the meaning of section 19 of the Trade Practices Act 1958 and, further, denied that the said agreements or arrangements were contrary to the public interest. And whereas the Commission heard evidence adduced by the Examiner and the Masterton members of the Association and heard Mr Orr of Counsel for the Examiner and Mr Blackwood of Counsel for the Masterton members of the Association. And whereas the Commission has found it unnecessary to make any finding in respect to the practices referred to in paragraphs (b), (c), and (d), aforesaid, and makes no orders in respect thereto. And whereas the Commission has found that the agreement or arrangement referred to in paragraph (a) aforesaid is a trade practice in terms of paragraph (a) of subsection 2 of section 19 of the Trade Practices Act 1958 and, further, that such trade practice is contrary to the public interest in terms of paragraph (d) of section 20 of the said Act and, further, that an order should be made under the said Act in respect of the said trade practice. Now, therefore, the Trade Practices and Prices Commission hereby orders and directs the Masterton members of the Wairarapa Branch of the Manawatu, Southern Hawke’s Bay, and Wairarapa Master Bakers’ Association: (a) To revoke their present agreement or arrangement whereby they agree not to deliver bread to a shop being supplied by a fellow baker; (b) To refrain from reviving the said agreement or arrangement in any form whether as members of the said Association or otherwise howsoever and to refrain from entering into any other agreement or arrangement which would have the same or substantially the same effect as the aforesaid agreement or arrangement; and (c) To pass at a meeting of the Masterton members of the Wairarapa Branch of the said Association to be held within 30 days of the date of coming into force of this order the following resolution: “Pursuant to the said order of the Trade Practices and Prices Commission dated the 4th day of February 1963 it is hereby resolved that the agreement or arrangement amongst Masterton members not to deliver bread to a shop or depot already being supplied by a fellow baker be and the same is hereby rescinded. “And it is hereby further resolved that henceforth the Masterton members shall refrain from entering into any agreement or arrangement which would have the same or substantially the same effect as the agreement or arrangement hereby revoked. “And it is hereby further resolved that a copy of this resolution be forwarded forthwith to all members and to the Examiner of Trade Practices and Prices.” Dated at Wellington this 4th day of February 1963.
