The Standards Act 1941—Draft New Zealand Standard Model Building Bylaw No. D 7547: Chapter 8, Basic Loads to be Used in Design and Their Methods of Application. (Revision of N.Z.S.S. 1900: Chapter 8: 1963—formerly N.Z.S.S. 95 : Part IV.)

PURSUANT to subsection (3) of section 8 of the Standards Act 1941, notice is hereby given that the above-mentioned draft New Zealand standard specification is being circulated. All persons who may be affected by this specification and who desire to comment thereon may, on application, obtain copies on loan from the New Zealand Standards Institute, Bowen State Building, Bowen Street, or Private Bag, Wellington C.1.

The closing date for the receipt of comment is 20 December 1963.

Order No. 5 (1963) of the Trade Practices and Prices Commission

In the matter of the Trade Practices Act 1958 and in the matter of an inquiry into the fixing of metal prices and delivery rates by the members of South Auckland Quarry Owners’ Association (now dissolved).

WHEREAS the Trade Practices and Prices Commission has, pursuant to section 18 of the Trade Practices Act 1958, conducted an inquiry into an agreement or arrangement between former members of the South Auckland Quarry Owners’ Association (hereinafter referred to as “the Association”) fixing the price at which metal is to be sold by members and the rates to be charged for cartage thereof.

And whereas, prior to the said inquiry, the Examiner of Trade Practices and Prices presented to the Commission a report pursuant to section 17 of the said Act.

And whereas the Examiner alleged, in his said report, that the members of the Association were parties to an agreement or arrangement as aforesaid.

And whereas a copy of the said report was duly served on the said Association.

And whereas the said Association was dissolved before the date fixed for an inquiry into the said alleged agreement or arrangement had arrived.

And whereas, pursuant to an order of the Commission, a copy of the said report was served on each member of the Association, and each such member was advised that the Commission would hold an inquiry into the alleged agreement or arrangement on the 26th day of June 1963 and, further, that if a member intended to oppose the making of an order sought by the Examiner he should furnish an answer not later than the 14th day of June 1963.

And whereas no member filed an answer to the said report.

And whereas at the said inquiry the commission heard Mr Orr of Counsel for the Examiner and Mr Goddard of Counsel for Tauwhare Metal Supplies Ltd., H. G. Leach and Co. Ltd., and Blue Metal Quarrying Co. Ltd.

And whereas the Commission has found that an agreement or arrangement as aforesaid existed between the following firms as members of the said Association at the time of its dissolution, namely:

Karapiro Quarries Ltd.
Page Construction Ltd.
Waikato Metal Supplies Ltd.
Whitehall Quarries Ltd.
Bitumix Ltd.
Tauwhare Metal Supplies Ltd.
H. G. Leach and Co. Ltd.
Blue Metal Quarrying Co. Ltd.
I. C. E. Lovelock Ltd.
Futaruru Quarries Ltd.
J. J. Craig Ltd.
Waotu Quarries Ltd.

And whereas the Commission has further found that the said agreement or arrangement constitutes a trade practice in terms of section 19 (2) (c) of the said Act and that the said trade practice is contrary to the public interest in terms of section 20 (1) (b) and (d) of the said Act and has decided that an order should be made under the said Act in respect of the said trade practice.

Now, therefore, the Trade Practices and Prices Commission, pursuant to section 19 and 21 of the Trade Practices Act 1958, hereby orders the aforesaid firms:

(a) To discontinue the said agreement or arrangement for fixing the prices at which metal is to be sold by the said firms and the rates to be charged for cartage thereon; and

(b) To refrain from reviving the said agreement or arrangement in any form whether as members of any Association or otherwise howsoever and to refrain from entering into any other agreement or arrangement which would have substantially the same effect.

And further orders each of such firms, within 28 days of the date of this Order coming into force,

(a) To discontinue invoicing sales of metal on the basis of the price last agreed upon by them as members of the said Association, and

(b) To fix its own prices thereafter without reference to or consultation in any way with its competitors.
