PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, the land described in the Schedule hereto is hereby taken subject as to Lot 14, D.P.S. 7196, to the drainage easement created by transfer S. 220771, South Auckland Land Registry, for Maori housing purposes from and after the 19th day of August 1963.

Declaring Easement Taken Over Land for the Purposes of an Aerodrome in Block IV, Maungatua Survey District


PURSUANT to section 32 of the Public Works Act 1928, the Minister of Works hereby declares that, a sufficient agreement to that effect having been entered into, an easement for the installation of poles, lights, power cables, and a maintenance access strip is hereby taken for the purposes of an aerodrome over the land described in the Schedule hereto, vesting in Her Majesty the Queen full and free right, liberty, licence, and authority in perpetuity to transmit electricity over, along, or under the land described in the Schedule hereto and for that purpose to lay, construct, place, and maintain a line of electric cables along or under the said land, and also to erect such poles, lights, and apparatus ancillary thereto as may be deemed necessary along a line extending from a point marked E to a point marked F on the plan marked M.O.W. 8165 (S.O. 13293); and for the purposes aforesaid to construct and maintain an access strip over the land described in the Schedule hereto vesting in Her Majesty the Queen, her agents, servants, workmen, contractors, licensees, and invitees full and free right, liberty, licence, and authority in perpetuity to enter from time to time and at all times by day or by night and to pass or repass, with or without horses, vehicles, machinery, materials, implements, and plant of any kind, over and along the said land for the purpose of repairing, maintaining, and replacing the said cables, poles, lights, and apparatus and the said access strip, such easement to be appurtenant to the land secondly described in the Schedule of the Proclamation dated the 2nd day of March 1960, published in Gazette, 10 March 1960, Volume I, page 313, and registered as No. 218735, Otago Land Registry; and hereby also declares that this declaration shall take effect from and after the 19th day of August 1963.

Agreement for Grant of Right of Way in Favour of Wilfred Arthur Chapman, of Waituna West, Storekeeper, Over Land Situated in Block XV, Ongo Survey District, Taken for an Automatic Telephone Exchange, Assented to


WHEREAS by a declaration dated the 1st day of July 1963, and published in Gazette, 11 July 1963, No. 41, page 946, all that piece of land containing approximately 8·2 perches being part Section 20, West Waitapu Village, and all that piece of land containing approximately 4·1 perches being part Section 20, West Waitapu Village, situated in Block XV, Ongo Survey District, were taken for an automatic telephone exchange:

And whereas Wilfred Arthur Chapman, of Waituna West, storekeeper, was entitled to compensation in respect of his interest in the said land:

And whereas the Minister of Works agreed to grant to the said Wilfred Arthur Chapman a right of way over the aforesaid area containing approximately 4·1 perches in addition to the payment of a sum of money in full satisfaction of the compensation aforesaid:

And whereas the said Wilfred Arthur Chapman agreed to accept such grant of right of way and sum of money in full satisfaction of the said compensation:

Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act 1928, that he assents to the agreement hereinbefore referred to.
