Land Set Apart as Provisional State Forest Declared to be Subject to the Land Act 1948

H. E. BARROWCLOUGH, Administrator of the Government A PROCLAMATION

PURSUANT to subsection (2) of section 19 of the Forests Act 1949, I, Major-General the Right Honourable Sir Harold Eric Barrowclough, the Administrator of the Government, acting on the joint recommendation of the Minister of Lands and of the Minister of Forests, hereby proclaim and declare that the land described in the Schedule hereto, being portion of provisional State forest set apart by Proclamation dated the 16th day of March 1920, and published in Gazette, 25 March 1920, Volume I, page 934, is required for settlement purposes; and in accordance with the provisions of the said Act such land shall, from and after the day of the gazetting hereof, cease to be provisional State forest land and shall become Crown land available for sale, lease, reservation, or other disposition under the provisions of the Land Act 1948.

SCHEDULE

NELSON LAND DISTRICT

ALL that area of provisional State forest in the Nelson Land District, Waimea County, containing 60 acres, more or less, bounded by a line commencing at the north-eastern corner of Section 2, Square 147, situated in Block X, Hope Survey District, and proceeding easterly along the southern boundary of part Scenery Preservation Reserve 2 (in red), Gazette, 1907, page 1236, to the western boundary of Section 4, Block X, Hope Survey District; thence southerly along the western boundary of the said Section 4 to Peg I, S.O. Plan 7401; thence generally south-westerly along the south-eastern boundary of the Waimea County to the eastern boundary of Section 2, Square 147, aforesaid; thence northerly along the eastern boundary of the said Section 2, Square 147, to the point of commencement.

As shown on the plan marked 4/333B deposited in the Head Office, Department of Lands and Survey at Wellington, and thereon edged red.

Declaring Land, Canterbury Land District, as a Wildlife Refuge in the Waimate Acclimatisation District

PURSUANT to section 14 of the Wildlife Act 1953, I, Major-General the Right Honourable Sir Harold Eric Barrowclough, the Administrator of the Government of New Zealand, hereby proclaim and declare the area described in the Schedule hereto to be a wildlife refuge for the purpose of the Wildlife Act 1953.

SCHEDULE

CANTERBURY Land District, Waimate County, being part Rural Section 28372, situated in Block XIII, Hakataramea Survey District: Area, 31 acres 3 roods 29 perches, more or less. All certificate of title, Volume 107, folio 67, as shown on plan marked I.A. 52/523 deposited in the Head Office, Department of Internal Affairs at Wellington, and thereon edged red. (S.O. Validating Proceedings in Connection with the Hawea Rabbit Board's Loan of £4,500

At the Government House at Wellington this 3rd day of October 1962

Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

WHEREAS the Hawea Rabbit Board is proceeding by way of special order to raise a loan of £4,500 to be known as the Housing Loan 1962; and whereas the special order made by the said Board was irregular or defective in that firstly, contrary to section 2 of the Local Authorities Loans Act 1956, the resolution to raise the said loan was confirmed at a subsequent meeting held later than the forty-second day after the day of the special meeting at which such resolution was passed, secondly, contrary to section 2 aforesaid, the interval between the two notifications of the place, time, and date of the subsequent meeting and of the purport of the resolution was less than 14 days, and thirdly, contrary to subsection (2) of section 34 of the Local Authorities Loans Act 1956, the statement required by that subsection to be contained in every public notice of the resolution purported to require any demand for a poll made by a ratepayer to be sent or delivered to the said Board so as to be received by the Board's secretary not later than two days before the date fixed for the confirmation of the resolution; and whereas it appears that the ratepayers of the district have not been misled by such irregularities or defects as aforesaid and it is expedient to validate the same: Now therefore, pursuant to section 130 of the Local Authorities Loans Act 1956, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the raising of the said loan shall be valid to all intents and purposes as though the said special order had been made in accordance with the provisions of sections 2 and 34 (2) of the Local Authorities Loans Act 1956, and hereby further orders and declares that the validity of the proceedings in connection with the raising of the said loan or of the security for the said loan shall not be questioned on the grounds of the irregularities or defects aforesaid.

Adding Land to the Fiordland National Park

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL

PURSUANT to section 10 of the National Parks Act 1952, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby declares that the land described in the Schedule hereto shall, as from the date hereof, be added to and form part of the Fiordland National Park and shall hereafter be managed, administered, and dealt with by the Fiordland National Park Board in accordance with the provisions of the said Act.

PURSUANT to the Public Works Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby revokes the Order in Council dated the 28th day of March 1956 and published in the Gazette on the 5th day of April 1956 at page 479, authorising Edith Annie Walker, of Nelson, widow, Stewart D'Arcy Walker, of Ashburton, civil servant, and Jessie Tempelton Gray, of Tirau, married woman, to use water for the purpose of generating electricity.
