and lodged at the offices of the Council at any time not later
than noon on Monday, 8 October 1962. An appropriate form
for use by objectors is available at the Council offices and
libraries.

At a later date every objection will be open for public
inspection. Any person who wishes to support or oppose any
objection will then be entitled to be heard at the hearing of
objections if he notifies the Council in writing within a period
of which public notice will be given.

PROPOSED CHANGES

7. Ordinance 2—Definitions

Definition for “Conditional Use” to be deleted and the
following substituted:

“‘Conditional Use’ in relation to land and to any building
in any zone means any use specified in these ordinances as
a use that is permitted only if the Council consents and
only subject to such conditions as the Council may impose
whether generally or in respect of the particular use or in
respect of a particular site.”

8. Ordinance 8 (3)

To be deleted and the following substituted:

“Where an application is made to the Council for a con-
ditional use of any land or building, if the Council so
determines, particulars of the proposal and special conditions,
restrictions, and prohibitions it contemplates shall be pub-
lished at the expense of the applicant in the official paper
of the Council circulating in the district, and shall give
written notice to adjoining owners and occupiers and such
other persons as, to the Council, appear likely to be affected.

9. Conditional Uses in Industrial “B” Zones

The following to be added:

“Non-residential clubs, places of assembly, including gym-
nasium and training sheds.”

10. Bulk and Location Requirements—Conditional Uses in

Residential “A” Zones

Other building classified in paragraphs (a) to (e), (g),
and (i) - the rear yard minimum depth of 5 ft to be deleted
and 25 ft substituted.

BAY OF ISLANDS COUNTY COUNCIL

TOWN AND COUNTRY PLANNING ACT 1953

Bay of Islands County District Scheme, Russell Section,

Approved

PURSUANT to the Town and Country Planning Regulations
1960, public notice is hereby given that the district scheme,
under the Town and Country Planning Act 1953, for the
Russell section of the Bay of Islands County District Scheme
was approved by the Council by resolution at its meeting held
on the 15th day of August 1962 after all objections to the
scheme had been disposed of and the scheme had been
amended to give effect to all objections allowed. The Council
also resolved that the scheme shall come into operation on
the 15th day of October 1962.

Copies of the scheme as approved have been deposited in the
Council’s office and in the office of the Russell Town Council
and may be inspected, without fee, by any person who so
requires at any time when these places are open to the public.

THE MINING ACT 1926

NOTICE is hereby given that Maurice Herbert Spain, of Crom-
well, farmer, has applied for a licence for a water race to
divert a one-third head by means of a 5 in. pipeline com-
mencing in the Clutha River at a point 30½ chains west of
Nine Mile Creek and running thence across River Reserve,
Section 20, Block XVIII, Leaning Rock District, underneath
the Central Otago Railway line and the Milton-Queenstown
State Highway and through Run 238D, Block XVIII, Leaning
Rock District, a total distance of 10 chains, and terminating
in a dam owned by the applicant as shown more particularly
on the plan attached to application 48/1962, Warden’s Court,
Cromwell.

The applications and all objections thereto will be heard at
the Warden’s Court, Cromwell, on Wednesday, 17 October
1962, at 10 a.m., and objections must be filed with the
Registrar and notified to the applicant at least three days
before the time so appointed.

THE MINING ACT 1926

NOTICE is hereby given that Herbert Arthur Grigg, of
Alexandra, has applied on behalf of Her Majesty the Queen
for two licences for dry races as set out in the Schedules
hereunder.

The applications and all objections thereto will be heard at
the Warden’s Court, Cromwell, on Wednesday, 17 October
1962, at 10 a.m., and objections must be filed with the
Registrar and notified to the applicant at least three days
before the time so appointed.

FIRST SCHEDULE

A pipeline not exceeding 10 in. in diameter commencing at
Miners Dam in Crown Land Section 49, Block V, Teviot
District, running thence generally in a southerly direction
through said Section 49 and Sections 121, 122, and 96, Block
II, Teviot District, a distance of 1 mile 45 chains, and termin-
ating in a ring main encircling the permanent village of the
State Hydro at Roxburgh, as the same is more particularly
shown on the plan attached to application 47/62, Warden’s
Court, Cromwell.

SECOND SCHEDULE

A pipeline not exceeding 1¼ in. in diameter commencing in
the ring water main of the State Hydro permanent village at
Roxburgh, running thence in a southerly direction a distance
of 75.2 links, and thence in a westerly direction a distance
of 45.5 links, and terminating in Section 160, Block II,
Teviot District, as shown on the plan attached to application
46/62, Warden’s Court, Cromwell.
