Order No. 7 (1961) of the Trade Practices and Prices
Commission

In the matter of the Trade Practices Act 1958 and in the
matter of an inquiry into an agreement or arrangement
between members of the New Zealand Master Grocers’
Federation and of the Master Grocers’ Association in
Auckland, Wellington, Canterbury, and Otago to sell goods
only at prices or on terms agreed between them.

Whereas the Trade Practices and Prices Commission by Order
No. 6 (1961) bearing date the 1st day of May 1961 and published
in the Gazette on the 11th day of May 1961 made
certain orders pursuant to a direction of the Trade Practices
Appeal Authority contained in his decision bearing date the
1st day of May 1961

And whereas the New Zealand Master Grocers’ Federation
and the Auckland, Canterbury, Buller, Gisborne, Hawke’s Bay,
Manawatu, Marlborough, Nelson, North Otago, Otago, South
Canterbury, Southland, Taranaki, Wanganui, Wellington, and
Westland Master Grocers’ Associations appealed against the
whole of the said orders

And whereas the Trade Practices Appeal Authority heard the
said appeal and by his final decision bearing date the 21st day
of August 1961 directed the Commission to amend its said
Order No. 6 (1961) in the manner hereinafter appearing

Now therefore the Trade Practices and Prices Commission
pursuant to section 35 of the Trade Practices Act 1958 hereby
orders that its said Order No. 6 (1961) be amended—

(a) By inserting after the word “discontinue”, in the phrase
“hereby orders the New Zealand Master Grocers’
Federation to discontinue the practice of setting prescribing or recommending retail grocery margins”, the
words “and not to repeat in any form”;

Federation and the Master Grocers’ Associations that
are members thereof not to repeat or carry on”, and
substituting the words “And further orders the Master
Grocers’ Associations that are members of the said
Federation not to act together in carrying on”.

Dated at Wellington this 1st day of September 1961.

The seal of the Trade Practices and Prices Commission was
affixed hereto in the presence of—
