Education and Election Rules




  1. Subject to the general direction of the Board, the Principal shall have the following powers:

(a) He shall have control of the buildings and premises of the establishment, and of the apparatus and furniture thereof:

(b) He shall have the power to recommend the appointment or dismissal of assistant teachers or of other officers of the establishment, and to allot their several duties; and no such assistant teacher or other officer shall be appointed until the Principal has been consulted as to his suitability:

(c) He shall have the power in case of grave neglect of duty or of gross misbehaviour to suspend any assistant teacher or other officer, but shall forthwith report his action to the Chairman; and the action of the Principal shall hold good until the Board has determined the matter:

(d) He shall be supreme over the discipline and may suspend from attendance any pupil; and in the case of every such suspension, he shall immediately notify the parents or guardian of the pupil of the suspension and the reasons therefor, and shall forward forthwith to the Board a full report of the suspension, but he shall not expel any pupil without the sanction of the Board:

(e) He shall regulate all textbooks, methods, and organisation in accordance with clause 50 hereof, and, subject to the same clause and to the regulations under the Education Act, shall determine the course of study for each pupil:

Provided that the textbooks shall be taken from the lists selected by the Director and approved by the Minister.

SCHEDULE

RULES FOR THE CONDUCT OF ELECTION OF MEMBERS BY PARENTS

(1) In this Schedule “elector” means a person whose name duly appears on the roll at the time when it is closed for the purposes of any election.

(2) For the purposes of each election the Returning Officer shall prepare a roll, and shall enter therein the name, occupation, and address of every person qualified to be enrolled as a parent of a pupil of the school. The roll shall be closed at 5 o'clock on the fourteenth day before the day on which any election is to be held, and shall continue to be closed until the election is completed.

(3) The roll shall at all reasonable times be open to inspection in the hands of the Returning Officer by any person whose name is entered therein and by any person representing to the Returning Officer that he is entitled to have his name entered therein.

(4) Any question that arises touching the right of any person to have his name entered in or retained on the roll shall be decided by the Returning Officer, and his decision shall be final.

(5) The Returning Officer shall, by advertisement in a newspaper circulating in the locality of the school, publicly notify not less than 21 days before each election—

(a) The day and hour for the closing of nominations:

(b) The total number of candidates to be elected:

(c) The day and hour for the closing of the poll.

The advertisement shall indicate generally the nature of the election which is being held.

(6) Every candidate shall be nominated in writing by one or more electors entitled to vote for his election.

(7) Every nomination paper shall be in the form or to the effect following:

  1. [Name and Address], being an elector duly entered on the roll, do hereby nominate [Name and Address] as a candidate for election to the Board of Governors of the [Name of School] at the election to be held on the day of 19....

CANDIDATE'S CONSENT

I hereby consent to my nomination.

(8) If the nomination paper does not bear the written consent of the candidate nominated, that consent may be given by him to the Returning Officer before the nominations are closed, and every nomination paper shall be void in so far as concerns any candidate whose written consent is not duly given as aforesaid.

(9) Nominations shall close at noon on the fourteenth day before the day of the closing of the poll; so that if a poll is to close on the fifteenth day of any month, nominations shall close on the first day of that month.

(10) Any question that arises touching the validity of a nomination paper, whether by reason of form, execution, time of receipt, or otherwise, howsoever, shall be decided by the Returning Officer, and his decision shall be final.

(11) If the number of nominations received does not exceed the number of vacancies to be filled, the Returning Officer shall forthwith declare the candidate or candidates so nominated to be duly elected.

(12) In all other cases the Returning Officer shall, as soon as the nominations are closed, prepare and post to each elector at his address as appearing on the roll a printed voting paper containing in alphabetical order of surnames a list of all the duly nominated candidates for whom the elector is entitled to vote; and the voting paper shall be in the form or to the effect following:

Voting paper for use at election to be held on the day of 19..., of Member of the Board of Governors of the [Name of School]

CANDIDATES

[Set out in alphabetical order of surnames the full name of every duly nominated candidate.]

DIRECTIONS

The number of candidates to be elected is [Specify the number].

The voter must draw a line through the name of every candidate for whom he does not intend to vote.

The number of candidates whose names are left uncancelled must not exceed _ .

The voting paper must be posted or delivered to the Returning Officer in a closed envelope bearing on the outside the word "Voting Paper", and on the inside of the flap of the envelope the signature of the voter. If posted to the Returning Officer it must be posted on or before the day of election, and, if delivered to him, must be delivered at his office, Street, before the day of election, or not later than 5 o'clock in the afternoon of that day.

(13) When posting any voting paper the Returning Officer shall enclose for the return of the voting paper an envelope addressed to himself with a place inside the flap for the signature of the voter.

(14) The poll shall close at 5 o'clock on the afternoon of the day of election; but all voting papers shall be included and counted which are not informal and are received by the Returning Officer in due course of post before the close of the seventh day after the day of the election.

(15) A voting paper shall be informal in any of the following cases:

(a) If the elector votes more than once at the same election;

or

(b) If the candidates whose names are left uncancelled exceed in number the total number of candidates for whom the elector is entitled to vote; or

(c) If in any other way the paper fails to indicate for whom the vote is intended to be given; or

(d) If, being delivered to the Returning Officer, otherwise than by post, the sealed envelope containing the voting paper is not delivered at his office before the close of the poll; or

(e) If, having been forwarded by post, the sealed envelope containing the voting paper is not received at the office of the Returning Officer before the close of the seventh day after the day of election, or if, from the postmark on the envelope or otherwise the Returning Officer is satisfied that it was not posted until after the day of the election; or

(f) If there is reasonable cause to believe that it was not issued to the voter by the Returning Officer; or

(g) If the voter fails to place his signature on the inside of the flap of the envelope.

(16) The Returning Officer shall decide whether a voting paper is invalid or informal whether by reason of the time of receipt or delivery or by reason of the fact that the voter's intention is not indicated, or for any other reason, and his decision shall be final.

(17) On the eighth day after the date of the closing of the poll, the Returning Officer shall open and examine all voting papers duly delivered to him or received by him through the post as aforesaid, and, after rejecting all informal voting papers, shall ascertain the candidates (not exceeding the total number to be elected) who have received the greatest number of votes, and shall declare those candidates to be elected.

(18) If by reason of an equality of votes given for two or more candidates the election is not complete, the Returning Officer shall decide by lot, in the presence of two members of the Board, which candidate or candidates shall be elected, and thereby complete the election.

(19) In connection with any such election:

(a) Each candidate may, by writing under his hand, appoint one scrutineer, who may be present at the examination of the voting papers and the counting of the votes by the Returning Officer:

(b) The Returning Officer shall, immediately after counting the votes, seal up all voting papers, and transmit the whole to the Clerk of the nearest Magistrate's Court, who shall keep the same for six months thereafter, and shall not open the packet or permit it to be opened except on the order of some Court of competent jurisdiction, and shall at the end of the six months effectually destroy the same:
