Notice to Make Returns of Income Under the Land and Income Tax Act 1954


PURSUANT to the Land and Income Tax Act 1954, the Commissioner of Inland Revenue hereby gives notice as follows:

  1. Returns of income for the year ended 31 March 1959 are required from:

(1) All companies, all partnerships, all persons in business (including farming), all persons in partnership, and all trustees, executors, and administrators, irrespective of whether a profit or a loss has been made:

(2) All persons not referred to in paragraph (1) who during the year derived income (whether assessable or non-assessable) exceeding in total £1,040:

(3) All persons who during the year derived assessable income, except persons—

(a) Who are pay period taxpayers in respect of that year and are not required by the Commissioner to furnish a return of income for that year; or

(b) Whose total income so derived in that year is not in excess of the total of £325 and whose income in that year, other than income from employment, consists exclusively of one or more of the following—

(i) Interest and investment society dividends not exceeding in the aggregate £12:

(ii) A superannuation benefit under Part II of the Social Security Act 1938:

(iii) Dividends (not being investment society dividends).

(4) All other persons who are required by the Commissioner or the Act to furnish returns.

  1. Returns are required to be furnished by posting or delivering the same to the office of the Taxes Division of the Inland Revenue Department nearest to the place of residence of the taxpayer or if the taxpayer’s records are held in another office of the Department then to the latter office.

(1) Not later than 7 June 1959 where the returns are for an accounting year ending with any day between 30 September 1958 and 8 April 1959:

(2) Within two months after the end of the accounting year where the returns are for an accounting year ending with any day between 7 April 1959 and 1 October 1959.

  1. All return forms are available at all district offices of the Taxes Division, Inland Revenue Department, and all forms other than those for companies are available at all post offices.

  2. Any person or company failing to furnish a return within the prescribed time is liable to a fine not exceeding £100 and not less than £2.

PURSUANT to regulation 3 (5) of the Heavy Motor Vehicle Regulations 1955,* the Commissioner of Transport hereby approves the Manukau County Council’s proposed classification of the main highway described in the Schedule hereto.

Order No. 1 (1959) of the Trade Practices and Prices Commission


In the matter of the Trade Practices Act 1958 and in the matter of an agreement between Alexander Clark Ltd., Smith and Smith Ltd., R. and E. Tingey and Co. Ltd., and Ward Bros. (Palmerston North) Ltd., members of the Palmerston North section of the Wellington Glass, Oil, and Colour Merchants’ Association, and an agreement between Auld and Gleeson Ltd., Coogan and O’Connell Ltd., Hill and Jackson Ltd., Smith and Smith Ltd., R. and E. Tingey and Co. Ltd., and the Wellington Plate Glass Works Ltd., members of the Wellington Glass and Wallpaper Merchants’ Association, and registered with the Commissioner of Trade Practices under Nos. 127 and 227.

WHEREAS the above agreements have been terminated by the parties thereto and whereas the Commissioner is of opinion that the repetition of the trade practice evidenced by the said agreements would be contrary to the public interest; now, therefore, the Trade Practices and Prices Commission, pursuant to section 19 of the Trade Practices Act 1958, hereby orders the parties to the said agreements not to revive the said agreements or to enter into any other agreement or agreements of substantially the same nature, or to repeat in any form the practice evidenced by the said agreements of submitting tenders on a basis prearranged between themselves provided that nothing in this order shall be deemed to prohibit joint tenders by the said parties.
