HAWKE'S BAY COUNTY COUNCIL

NOTICE OF INTENTION TO TAKE LAND

NOTICE is hereby given that the Hawke's Bay County Council proposes, under the provisions of the Counties Act 1956, to execute a certain public work, namely, to provide a Fire Station for the prevention of fires; and for the purposes of such public work the land described in the Schedule hereto is required to be taken; and notice is hereby further given that the plan of the land so required to be taken is deposited in the public office of the Clerk of the said Council, in Browning Street, Napier, and is open for inspection, without fee, by all persons during ordinary office hours.

All persons affected by the execution of the said public work or by the taking of the said land who have any well grounded objections to the execution of the said public work or to the taking of the said land must state their objections in writing and send the same within forty (40) days from the first publication of this notice to the County Clerk at the Council Chambers.

SCHEDULE
THIRTY-EIGHT decimal six perches (38·6p), being Lot 94 on Deeds Plan 34, being part Suburban Section 9, Meeanee, situated in Block VIII, Heretaunga Survey District; situate in the County of Hawke's Bay in the Land Registration District and Land District of Hawke's Bay; as the same is more particularly delineated on the plan marked 3059 deposited in the office of the Chief Surveyor at Napier, and thereon coloured blue.

RODNEY COUNTY COUNCIL

TOWN AND COUNTRY PLANNING ACT 1953

PUBLIC notice is hereby given that the Rodney County Council, at its meeting held on the 25th day of June 1957, has resolved to prepare for the County of Rodney a district scheme as required by the provisions of the Town and Country Planning Act 1953.

Every person and every local authority in the district is hereby invited to submit any proposals which, in his or its opinion, should be considered in the preparation of the proposed scheme.

Proposals marked “Rodney County Council District Scheme” should be addressed to the County Clerk and delivered at the County Clerk's office on or before the 20th day of September 1958.

WAIPARA COUNTY COUNCIL

TOWN AND COUNTRY PLANNING ACT 1953

PUBLIC notice is hereby given that the Waipara County Council, at its meeting held on the 12th day of November 1956, has resolved to prepare for the Waipara County a district scheme as required by the provisions of the Town and Country Planning Act 1953.

Every person and every local authority in the district is hereby invited to submit any proposals which, in his or its opinion, should be considered in the preparation of the proposed scheme.

Proposals marked “Waipara County District Scheme” should be addressed to the County Clerk and delivered at the County Clerk's office on or before the 30th day of September 1958.

CHARITABLE TRUSTS ACT 1957

In the matter of the Wellington District Nursing Guild of the Order of the Hospital of St. John of Jerusalem in England (commonly called “The District Nursing Guild of St. John”).

NOTICE is hereby given pursuant to section 36 of the Charitable Trusts Act 1957, that the above-described Guild has applied to the Supreme Court at Wellington for approval of a scheme for disposition of the funds of the said Guild.

The present purpose of the said Guild is defined in its constitution as follows:

“The object and general purposes of the Guild are to afford skilled nursing for the poor in their own homes during severe illness by professional nurses and the sisters of St. John, and shall be carried out on strictly non-sectarian and non-political lines.”

Particulars of the said scheme are as follows:

(a) The funds of the Guild to be transferred to “The Commandery in New Zealand of the Order of St. John Trust Board”.

(b) The said funds to be administered by a committee comprising three senior officers of the St. John Ambulance Brigade (Wellington Centre), one person nominated by the Mayor of Wellington, and one person to be nominated by the Medical Officer of Health at Wellington.

(c) The said funds to be invested and the income therefrom to be paid to institutions, societies, or organisations carrying on in the City of Wellington the work of providing or paying for food, medicines, personal clothing, bed clothing, fuel, lighting, heating, and other necessaries or comforts for sick, aged, destitute, poor, or helpless persons residing in the said City.

(d) The present trustees of the said funds to be released from the trusts declared by the Trust Deed of the Guild.

A copy of the said scheme has been filed in and may be inspected at the Registry of the said Court.

It is proposed that the application for approval be heard by the Supreme Court at Wellington, on Wednesday, the 24th day of September 1958.

Any person desiring to oppose the said scheme is required to give written notice of his intention to do so to the Registrar of the Supreme Court at Wellington, and to the trustees of the said Guild, and to the Attorney-General not less than seven clear days before the said date proposed for hearing of the application.

In the matter of The Judicature Act 1908, in the matter of The Charitable Trusts Act 1957, and in the matter of the estate of Elizabeth Gertrude Lister-Kaye, late of Streatham, Norwood, in the County of Surrey, England, and formerly of Wellington, New Zealand, widow, deceased.

WHEREAS the above-named Elizabeth Gertrude Lister-Kaye died in England on 26 March 1923; and whereas probate of her last will and codicil thereto was duly granted to the Public Trustee of New Zealand by the Supreme Court at Wellington; and whereas the said will provided, inter alia, that the residuary estate should be held by the Public Trustee after the fulfilment of certain prior trusts upon trust for the relief of destitute women of good education and respectable character in Wellington, and directed that the income arising from the said residuary estate should be paid by the Public Trustee to a committee consisting of the Anglican Bishop of Wellington and the two eldest Anglican clergymen in Wellington to be applied by them for the purposes aforesaid; and whereas the Public Trustee has made application to the Supreme Court for approval of a scheme varying the mode of administering the aforesaid Trust by providing that the Public Trustee shall pay the income from the aforesaid residuary estate to the Wellington City Mission (Church of England) Trust Board, to be applied by it for the purpose of the Trust, instead of paying it to a committee consisting of the persons mentioned above.

Take notice that the aforesaid application will be heard in the Supreme Court House, Wellington, on Monday, 4 August 1958, at 10 a.m.; and further take notice that any person desiring to oppose the aforesaid scheme shall give written notice of his or her intention to do so to the Registrar of the Supreme Court, Wellington, to the Public Trustee, and to the Attorney-General, not less than seven clear days before the aforesaid day for the hearing of the application.
