Varying a Condition as to Setting Back the Building Line of Portion of a Street in the City of Wellington, Imposed by Order in Council, Under Section 117 of the Public Works Act 1905

At the Government House at Wellington this 25th day of February 1958

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 15th day of July 1907, published in Gazette, 18 July 1907, Volume II, page 2138, and deposited in the Land Registry Office at Wellington as No. 285, exempting Botanical Gardens Road (now Salamanca Road) in the City of Wellington from the provisions of Section 117 of the Public Works Act 1905, subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said Order in Council so that no building or part of a building shall at any time be erected on Lot 2, D.P. 18725, within a distance of 25 ft. from the centre line of the said street.

At the Government Buildings at Wellington this 3rd day of March 1958

THE HON. C. F. SKINNER, M.C., PRESIDING IN COUNCIL

PURSUANT to section 131 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 7th day of October 1912, published in Gazette, 10 October 1912, Volume II, page 2943, and deposited in the Land Registry Office at Wellington under No. 686, exempting Hanover Street, Wadestown, in the City of Wellington, from the provisions of section 117 of the Public Works Act 1908, subject to a condition as to the building line, by varying the condition with regard to the building line imposed by the said Order in Council, so that no building or part of a building shall at any time be erected on Lot 7, D.P. 198, part certificate of title, Volume 44, folio 281, Wellington Land Registry, within a distance of 25 ft. from the centre line of the said street.

Cancellation of the Reservation Over a Reserve at Rarotonga, Cook Islands

At the Government House at Wellington this 25th day of February 1958

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 361 of the Cook Islands Act 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby cancels the reservation as a reserve for a site for public buildings over the land described in the Schedule hereto.

SCHEDULE

ALL those parcels of land, situated in the District of Arorangi in the Island of Rarotonga, Cook Islands, containing 1 rood 28 perches and 22 perches respectively, more or less, being all the land taken by Order in Council dated the 1st day of September 1911, and forming part of the land named by the Native Land Court Akaoa, Section 2, Akaoa Tapere; as the same are delineated and coloured red on the plan signed by the Resident Commissioner of Rarotonga and deposited in the office of Registrar of the High Court of the Cook Islands at Rarotonga under No. 67.

Adding Land to the Mount Cook National Park

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 10 of the National Parks Act 1952, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the land described in the Schedule hereto, being Crown land subject to the provisions of the Land Act 1948, shall as from the date hereof be added to and form part of the Mount Cook National Park, and shall hereafter be managed, administered, and dealt with by the Mount Cook National Park Board in accordance with the provisions of the first-mentioned Act.

SCHEDULE

CANTERBURY LAND DISTRICT

ALL that area in the Canterbury Land District, Mackenzie County, containing 21,100 acres, more or less, being Crown land, formerly part Run 80 (Godley Peaks) and Crown land adjoining, Godley Riverbed and Crown land, formerly part Run 78 (Lilybank), situated in Cook, Godley, and Torlesse Survey Districts, bounded as follows:

Commencing at a point on the left bank of the Godley River, due west of Trig. Station R, situated in Block X, Godley Survey District; thence proceeding due westerly along a right line to the right bank of the Godley River; thence north-westerly generally along the right bank of that river to and along the right bank of Rutherford Stream and the right bank of the southern branch thereof to its source on the summit of the Liebig Range near Surprise Glacier, the said summit being the boundary of the Mount Cook National Park; thence north-easterly generally along the boundary of that park to the summit of the Two Thumb Range; thence southerly generally along that summit to Mount Earle in Block III, Godley Survey District; thence south-westerly generally along the summit of the ridge containing Mount Forbes and Mount Sibbald to the source of McKinnon Stream; thence south-westerly to and along the left bank of that stream to the left bank of the Godley River; thence southerly along the left bank of that river to the point of commencement.

As shown on the plan marked L. and S. 4/1115A deposited in the Head Office, Department of Lands and Survey at Wellington, and thereon edged blue.

PURSUANT to section 10 of the National Parks Act 1952, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the lands described in the Schedule hereto, shall as from the date hereof be added to and form part of the Abel Tasman National Park, and shall hereafter be managed, administered, and dealt with by the Abel Tasman National Park Board in accordance with the provisions of the said Act.
