Notice by the Public Trustee Under the Public Trust Office Act 1908 (Part III) and its Amendments
WHEREAS it has been reported to the Public Trustee that Charles William Broad, formerly of Dunollie, retired miner, is the owner of certain real and personal property comprising cash in possession, cash to his credit in the Post Office Savings Bank of New Zealand and in the National Bank of New Zealand, furniture, jewellery, 1939 Chevrolet motor car, race horses, and the following land, namely, Allotment 19, Block IV, Square 124, Cobden Survey District, situate in the Town of Dunollie, comprising 24 perches, more or less, and being the whole of the land comprised in certificate of title, Volume 17, folio 58, Westland Registry, and Lots 1 and 2 of Block II, on Deposited Plan 148 (Township of Dunollie), being part of Section 4 of Square 124, situate in the Borough of Runanga, comprising 1 rood 8 perches, more or less, and being the whole of the land comprised in certificate of title, Volume 53, folio 235, Westland Registry, and whereas the value of all of such real and personal property does not exceed £1,000 (one thousand pounds), and whereas it is not known where the said Charles William Broad is or whether he is alive or dead, and whereas Part III of the Public Trust Office Act 1908 and its amendments provides (inter alia) that when it is not known where the owner of any real or personal property is or whether he is alive or dead and the value of such real or personal property does not exceed £1,000 (one thousand pounds) and that the exercise of the powers set out in section 87 of the said Act is advisable in the interests of such owner or of any other person, the Public Trustee may by notice in the Gazette declare his intention to take possession of such property and to exercise the powers conferred upon him by the said section 87 of the Public Trust Office Act 1908, and may thereafter exercise such powers without application to the Supreme Court.
Now the Public Trustee hereby gives notice that pursuant to Part III of the said Act he intends forthwith to take possession of the property above mentioned and to exercise in respect thereof the powers conferred upon him under and by virtue of the provisions of the said section 87 of the Public Trust Office Act 1908, as amended by section 21 of the Finance Act (No. 2) 1936.
