Authorising the Borrowing by the Hutt County Council by Way of Hypothecation of Debentures

ORDER IN COUNCIL
At the Government House at Wellington this 16th day of January 1957
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS, by Orders in Council made on the 20th day of October 1954, consent was given to the raising by the Hutt County Council (hereinafter called the said local authority) of the respective loans or parts thereof stated in the first column of the Schedule hereto:
And whereas the said local authority, pending the raising of the said respective loans or parts thereof, is desirous of borrowing the respective sums stated in the second column of the said Schedule by hypothecation or mortgage, pursuant to section 34 of the Local Bodies' Loans Act 1926, of the debentures authorised to be issued in respect of the said respective loans or parts thereof:
Now, therefore, pursuant to section 7 of the Local Authorities Interest Reduction and Loans Conversion Act 1932–33 and section 8 of the Local Authorities Interest Reduction and Loans Conversion Amendment Act 1933, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the said local authority, pending the raising of the said respective loans or parts thereof, borrowing the said respective sums or parts thereof by the hypothecation or mortgage of the said debentures to the State Advances Corporation of New Zealand at a rate of interest not exceeding 4 per cent per annum, such interest to be computed on the daily debtor balances in the accounts of the Corporation, repayable on demand, but so that the term shall expire not later than the 30th day of April 1957; and hereby prescribes that the money borrowed by the hypothecation or mortgage of the said debentures shall, pending the raising of the said respective loans or parts thereof, be repaid by annual or half-yearly instalments equivalent to the instalments of principal which would have been repaid if on the first day on which any money is borrowed by such hypothecation or mortgage the whole of the amount hereby authorised to be hypothecated or mortgaged had in each respective case been raised on the conditions already determined under the Local Government Loans Board Act 1926.

Validating Proceedings in Connection With the Feilding Borough Council's Loan of £5,100

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Feilding Borough Council is proceeding by way of special order to raise a loan of £5,100 to be known as Pensioners' Flats Loan 1956 (hereinafter called the said loan):
And whereas the proceedings in connection with the said loan have been irregular or defective in that the confirming meeting as required by paragraph (b) of section 77 of the Municipal Corporations Act 1954 was held sooner than the twenty-eighth day after the day of the special meeting held pursuant to paragraph (a) of the said section 77:
And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:
Now, therefore, pursuant to section 122 of the Local Bodies' Loans Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the confirming meeting had been held not sooner than the twenty-eighth day after the day of such special meeting, and that the validity of the proceedings in connection with the said loan or of the security for the said loan shall not be called in question by reason only of the irregularity or defect aforesaid.

Validating Proceedings in Connection with Waitomo Electric Power Board’s Loan of £20,000

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Waitomo Electric Power Board is proceeding by way of special order to raise a loan of £20,000 to be known as Building Completion Loan 1955 (hereinafter called the said loan):
And whereas the proceedings in connection with the said loan have been irregular or defective in that public notice of the resolution to make the special order authorising the raising of the loan, although given four times, was not given once in each of the four weeks immediately preceding the day on which the meeting was held for the purpose of confirming that resolution, as required by paragraph (c) of subsection (1) of section 45 of the Electric Power Boards Act 1925;
And whereas it appears that the ratepayers of the district have not been misled by such irregularity or defect as aforesaid and it is expedient to validate the same:
Now, therefore, pursuant to section 122 of the Local Bodies’ Loans Act 1926, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the proceedings in connection with the said loan shall be valid to all intents and purposes as though the public notices had been correctly given, and that the validity of the proceedings in connection with the said loan or of the security for the said loan shall not be called in question by reason of the irregularity or defect aforesaid.

Authorising Gilbert Norman Johnson, of Karamea, Dairy Farmer, to Erect and Use Certain Electric Lines in the County of Buller

ORDER IN COUNCIL
At the Government House at Wellington this 23rd day of January 1957
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises Gilbert Norman Johnson, of Karamea, dairy farmer (hereinafter referred to as the licensee), subject to the conditions hereinafter set forth, to lay, construct, put up, place, and use the electric lines described in the Schedule hereto.
CONDITIONS
IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.
    LICENCE SUBJECT TO REGULATIONS
  2. The licence hereby conferred is subject to compliance by the licensee with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with all regulations hereafter made in amendment thereof or in substitution therefor respectively.
    SYSTEM OF SUPPLY
  3. The system of supply shall be as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935, and shall be a direct-current system.
    DURATION OF LICENCE
  4. Unless sooner lawfully determined, this licence shall continue in force until the 31st day of March 1977, or until electrical energy is available from an electric power board or some other public source of supply, whichever is the earlier.
    SCHEDULE
    LINES for the supply of electrical energy by the system of supply hereinbefore described, commencing from the licensee’s generator situated in part Section 3, and proceeding in a southerly direction to a house situated in Lot 1, D.P. 5240, Section 3; all being situated in Block IX, Oparara Survey District, in the County of Buller; the said lines being more particularly shown by means of red lines on the plan marked S.H.D. 415 deposited in the office of the State Hydro-electric Department at Wellington.
