Conferring the Powers of a Tribal Executive Upon a Tribal Committee

ORDER IN COUNCIL

At the Government House at Wellington this 6th day of November 1956

Present:

HIS EXCELLENCE THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 7 of the Maori Purposes Act 1948, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby confers upon the Whanaunga Tribal Committee all of the powers conferred upon a tribal executive by the Maori Social and Economic Advancement Act 1945, including the power to make bylaws, notwithstanding the provisions of section 19 or section 20 of that Act.

The Ashley Rural Fire District Order 1948, Amendment No. 1

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to the Forest and Rural Fires Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. This order may be cited as the Ashley Rural Fire District Order 1948, Amendment No. 1, and shall be read together with and deemed part of the order constituting the Ashley Rural Fire District made on the 17th day of November 1948* (hereinafter referred to as the principal order).

  2. The principal order may hereafter be cited as the Ashley Rural Fire District Order 1948.

  3. The Schedule to the principal order is hereby amended by omitting the Schedule thereto and substituting the Schedule set out in the Schedule to this order.

SCHEDULE

Schedule to be substituted for the Schedule to the principal order:

"SCHEDULE

"CANTERBURY LAND DISTRICT—CANTERBURY CONSERVANCY

"Ashley Rural Fire District

"All that area in Ashley and Kowai Counties, containing approximately 24,400 acres, situated in Blocks V, VI, IX, X, XI, XIII, XIV, and XV, Grey Survey District, and Blocks I, II, and III, Rangiora Survey District, and bounded generally as follows: towards the north-east and north-west by the south branch of the Kowai River; towards the south-west by a stream, forming the boundary of Rural Section 32544, to the western side of Loburn Road; towards the north-west generally by the north-western side of Loburn Road to its junction with a road line traversing Rural Section 32544; towards the north generally by the aforesaid road line; towards the east generally by a road line traversing Rural Section 32546 and another road line to a point in line with the south-eastern boundary of Rural Section 30463; thence by a right line to the north-eastern corner of the last-mentioned section, and by Rural Sections 37083, 33809, and 17087; towards the north-east by the north-eastern side of Ashworth Bush Road; towards the south-east by Rural Section 29781; towards the north-east generally by Rural Sections 29781 and 16252, Fox's Creek, and the north-eastern side of McLeod's Road; towards the south-east by the south-eastern side of Marshman's Road; towards the south-west by the south-western side of a public road traversing Rural Section 8106; towards the south-east by the south-eastern sides of Boundary Road and Dixon's Road; towards the south-west by the south-western sides of Cone’s Road and Carr’s Road; towards the south-east by the south-eastern side of a public road forming the south-eastern boundary of Rural Section 8253; towards the south-west and north-west by the Makerikeri River to a point opposite the north-eastern corner of Rural Section 32733; towards the south-west by the crossing of the Makerikeri River; thence by Rural Section 32733, to and across the Lowburn and Kowai Road and by the south-western side of that road; towards the north-west generally by the north-western side of the last-mentioned road, Rural Section 34688, the left bank of the Grey River, and permanent State forest land (Gazette, 1898, page 1458); towards the north-east by the aforesaid permanent State forest land, to its junction with the south branch of the Kowai River. As shown on plan No. 136/20 deposited in the Head Office of the New Zealand Forest Service at Wellington, and thereon bordered red."

The Eskdale Cemetery Order 1956

ORDER IN COUNCIL

At the Government House at Wellington this 6th day of November 1956

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to the Cemeteries Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited as the Eskdale Cemetery Order 1956.

(2) This order shall come into force on the fourteenth day after the date of its publication in the Gazette.

  1. The Hawke’s Bay County Council is hereby appointed to be the trustee of the Eskdale Cemetery (formerly known as the Petane Cemetery), being the area described in the Schedule hereto, and shall have the control and management of that cemetery under and for the purposes of the Cemeteries Act 1908.

  2. (1) The delegation to the Hawke’s Bay County Council of the powers of appointing and removing trustees of the said cemetery, made by Order in Council dated the 18th day of September 1933,* is hereby revoked.

(2) The said Order in Council is hereby accordingly amended by omitting from the second column of the Schedule the word “Petane”, where it appears opposite the reference to the Hawke’s Bay County Council in the first column of that Schedule.

SCHEDULE

ESKDALE CEMETERY

All that area in the Hawke’s Bay Land District containing 5 acres and 2 perches, more or less, being Section 43, Block XII, Puketapu Survey District.

Authorising the Laying Off of Streets off Lorna Street in the City of New Plymouth, Subject to Conditions as to the Building Lines

ORDER IN COUNCIL

At the Government House at Wellington this 6th day of November 1956

Present:

HIS EXCELLENCE THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 186 of the Municipal Corporations Act 1954 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorises the New Plymouth City Council to permit the laying off of the proposed street first described in the Schedule hereto at a width for part of its length of less than 66 ft., but not less than 50 ft., and of the proposed street secondly described in the said Schedule at a width for part of its length of less than 66 ft., but not less than 40 ft., subject to the condition that no building or part of a building shall at any time be erected on Lots 2, 3, and 5 to 25 (inclusive), of a subdivision of the land shown edged green on the plan marked P.W.D. 150890, referred to in the said Schedule, within a distance of 40 ft. from the centre line of the proposed street first described in the Schedule hereto, or within a distance of 35 ft. from the centre line of the proposed street secondly described in the Schedule hereto.

SCHEDULE

First, that proposed street in the Taranaki Land District, City of New Plymouth, containing by admeasurement 3 roods 1 perch, more or less, shown as Lots 32 and 34 on the plan marked P.W.D. 150890, hereinafter referred to, being part Lot 6, D.P. 7843, being part Section 11, Fitzroy District.

Secondly, that proposed street in the said land district and city containing by admeasurement 30 perches, more or less, shown as Lot 33 on the said plan marked P.W.D. 150890, being part Lot 6, D.P. 7843, being part Section 11, Fitzroy District.

As the same are more particularly delineated on the plan marked P.W.D. 150890 deposited in the office of the Minister of Works at Wellington, and thereon coloured red.
