PURSUANT to section 53 of the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Lyttelton Harbour Board to invest in debentures of the loans shown in the first column of the Schedule hereto out of its funds shown in the second column of the Schedule hereto the sums shown in the third column of the Schedule hereto.

Amending Order in Council Licensing the Thames County Council to Use and Occupy Parts of the Foreshore at Puriri, on the Waihou River, and at Whangamata in Whangamata Harbour, as Sites for Wharves

PURSUANT to the Harbours Act 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby amends the Order in Council dated the 17th day of February 1943 and published in the Gazette of the 25th day of the same month at page 225, licensing and permitting the Thames County Council to use and occupy parts of the foreshore and land below low-water mark for the purpose of maintaining wharves thereon and making regulations and prescribing dues for the use of the said wharves—
(a) By omitting the words “at Puriri, on the Waihou River, and at Whangamata, Whangamata Harbour, as shown on approved plans marked M.D. 6811 and 6597 respectively”, and substituting the words “at Whangamata, Whangamata Harbour, as shown on approved plan marked M.D. 6597”;
(b) By omitting from clause 1 of the Third Schedule the words “Puriri or” wherever they occur.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, and the Electric Power Boards Act 1925, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.
LICENCE

This order may be cited as the Bay of Islands Electric Power Board Water Power Licence 1955.

Subject to the conditions hereinafter set forth, the Bay of Islands Electric Power Board (hereinafter referred to as the licensee) is hereby authorized to obstruct, impound, or divert the waters of the Keri Keri River and the Puketotara Stream, both situated in the Keri Keri Survey District in the North Auckland Land District, and to take and use therefrom for the purpose of generating electricity streams of water not exceeding 33 cubic feet per second and 8 cubic feet per second respectively.

The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated herein and shall form part of this licence, except in so far as they may be inconsistent with the provisions hereof.

This licence is issued under the Water Power Regulations 1934 and is subject thereto, and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations made in amendment thereof or in substitution therefor, except in so far as they may be inconsistent with the provisions hereof.

The said water shall be taken from the Keri Keri River at a point approximately 50 chains upstream from its confluence with the Puketotara Stream, as indicated on the plans marked S.H.D. 374 and S.H.D. 375 deposited in the office of the State Hydro-electric Department at Wellington, and shall be taken from the Puketotara Stream at a point approximately 24 miles upstream from its confluence with the Keri Keri River, as indicated on the plan marked S.H.D. 373 deposited as aforesaid.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the works described in the Schedule hereto, the positions of the said works being indicated on the said plans S.H.D. 373, S.H.D. 374, and S.H.D. 375.

The systems of supply shall be as described in paragraphs (a) and (f) of regulation 21-01 of the Electrical Supply Regulations 1935.

For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 121 kilovolt-amperes.

Nothing in this licence shall of itself be deemed to confer upon the licensee any right to water.

This licence shall, unless sooner lawfully determined, continue in force until the 31st day of March 1979.
SCHEDULE
GENERAL description of generating works—
(a) A weir and intake in the Puketotara Stream with a diversion race leading therefrom to a watercourse flowing into the Keri Keri River;
(b) Main headworks consisting of a weir and intake in the Keri Keri River with a water race leading therefrom to a pipe line leading into the powerhouse hereinafter referred to giving a static head of approximately 134 ft.;
(c) A water turbine, generator, and all necessary hydraulic and electrical equipment housed in a powerhouse situated in Block XI, Kori Keri Survey District;
(d) A tail race leading from the powerhouse aforesaid to the Keri Keri River.
