  1. In the case of any dispute arising between the licensee and any consumer in respect of any matter affected by this order, a Board of Appeal, whose decision shall be final, shall be set up, to decide the dispute. The Board of Appeal shall consist of the following:

(a) A Magistrate, who shall be Chairman:
(b) One representative appointed by the licensee:
(c) One representative appointed by the consumer.

The costs of setting up the Board of Appeal shall be payable by the parties in such proportions as the Board may decide.

  1. Notwithstanding anything in this order or in the Wellington City Council Electric Lines Licence 1955, the Electrical Supply Regulations 1935, the Electric Wiring Regulations 1935, or any order, licence, or regulations made or granted in amendment thereof or in substitution therefor, no person shall be entitled to demand, and the licensee shall not be obliged to afford, a supply of electrical energy on the direct-current system for any installation or any part or extension of any installation, or any appliance, apparatus, equipment, or motor, for which the licensee is not at the date of this order supplying electrical energy on the direct-current system:

Provided that the licensee may in its discretion afford a supply of electrical energy on the direct-current system for any such part or extension of any installation, or any such appliance, apparatus, equipment, or motor, if in its opinion the supply so afforded will not involve any substantial variation or increase in the supply previously given on the direct-current system for the installation affected:

Provided further that the affording of any such supply shall not debar the licensee from exercising at any time any of the rights and powers conferred on it by this order.

Authorizing Kare Kare House Limited to Use Water for the Purpose of Generating Electricity and to Erect and Use Certain Electric Lines

ORDER IN COUNCIL

At the Government House at Wellington this 16th day of November 1955

Present:

His Excellency the Governor-General in Council

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby grants to Kare Kare House Limited, a duly incorporated company having its registered office at Kare Kare (hereinafter referred to as the licensee), a licence, subject to the conditions hereinafter set forth, to take and use from the Kare Kare Stream (hereinafter referred to as the said stream) situated in Section S.E. 45, D.P. 2947, Block VII, Waitakerei Survey District, in the County of Waitemata, for the purpose hereinafter set forth, a stream of water not exceeding five cubic feet per second at any one time, and to lay, construct, put up, place, and use the electric lines hereinafter described.

CONDITIONS

IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Water Power Regulations 1934 and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence, except in so far as the same may be inconsistent with the provisions hereof.

LICENCE SUBJECT TO REGULATIONS

  1. This licence is issued under the Water Power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electric Wiring Regulations 1935, the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

UTILIZATION OF WATER AND LOCATION OF HEADWORKS

  1. Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at the point in Section S.E. 45, D.P. 2947, Block VII, Waitakerei Survey District, indicated on the plan marked S.H.D. 362 deposited in the office of the State Hydro-electric Department at Wellington.

GENERAL DESCRIPTION OF WORKS

  1. The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence, the positions of the said works being indicated on the said plan S.H.D. 362.

(a) Headworks consisting of an intake, water race, and pipe line leading to the powerhouse hereinafter referred to, giving a static head of approximately 150 ft.

(b) Water wheel and powerhouse with all necessary equipment for generating electricity, situated in Section S.E. 45, D.P. 2947, aforesaid.

(c) Tail race leading from the said powerhouse back to the said stream.

(d) Electric lines leading from the said powerhouse generally in a north-westerly direction across a public road to a house situated in Section S.E. 45, D.P. 2947, aforesaid, the said lines and buildings being more particularly shown on the said plan S.H.D. 362.

SYSTEM OF SUPPLY

  1. The system of supply shall be a direct current system as described in paragraph (d) of regulation 21-01 of the Electrical Supply Regulations 1935.

DURATION OF LICENCE

  1. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1976 or until electrical supply is available from an electric power board or some other public source of supply, whichever is the earlier.

RENTAL

  1. For the purpose of assessing the rental or annual sum payable in respect of this licence, the licensee may install a suitable maximum demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 7·25 kilowatts.

NO RIGHT TO WATER CONFERRED

  1. Nothing in this licence shall of itself confer upon the licensee any right to water.

PURSUANT to section 15 of the Royal New Zealand Air Force Act 1950, His Excellency the Governor-General has been pleased to approve the following appointments, promotion, extension of commission, transfers, and cancellations of commissions of officers of the Royal New Zealand Air Force:

GENERAL DUTIES BRANCH

Appointment

Kenneth Stewart MASSICKS (75152) is granted a short-service commission in the General Duties Branch, Regular Air Force, for a period of five years with the rank of Flight Lieutenant and with seniority as from date of appointment, to be followed by a period of four years in the Reserve of Air Force Officers, with effect from 24 March 1953.

Appointment and Cancellation

Arthur Maldwyn ROWLANDS (822938) is granted a short-service commission in the General Duties Branch, Regular Air Force, for a period of four years with the rank of Acting Pilot Officer and with seniority as from date of appointment, to be followed by a period of four years in the Reserve of Air Force Officers, with effect from 22 April 1955. This cancels previous temporary commission notified in Gazette No. 37, dated 2 June 1955, page 883.

Cancellations of Commissions.

The commissions of the undermentioned Acting Pilot Officers are cancelled with effect from the dates shown:

Appointment

Warrant Officer Leslie William THOMPSON, M.B.E. (70756), is granted a permanent commission in the Administrative and Supply Branch (Secretarial Division) with the rank of Flying Officer and with seniority as from date of appointment, with effect from 19 October 1955.

Transfer

Special Duties Division

Flight Lieutenant Raymond George JEFFS (70097) is transferred from the General Duties Branch to the Administrative and Supply Branch (Special Duties Division), with effect from 25 March 1955.

Promotion

Flight Lieutenant Raymond George JEFFS (70097) is granted the rank of Squadron Leader, with effect from 1 April 1955.

Extension of Commission

Flight Lieutenant (Temporary Squadron Leader) William Charles Joseph WILLIAMS, B.A., Dip.Ed. (130148), is granted an extension of his present commission for a period of four and a half years, with effect from 1 July 1956.

Amendment

In Gazettes No. 35, dated 9 June 1949, page 1325, No. 67, dated 16 August 1951, page 1187, and No. 33, dated 12 May 1955, page 769, the notices published relating to “Joseph Charles WILLIAMS” should read “William Charles Joseph WILLIAMS”.
