The Hawksbury Rabbit District Order 1955 (Notice No. Ag. 5968)

At the Government House at Wellington this 21st day of September 1955

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Rabbit Nuisance Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

ORDER

  1. (1) This order may be cited at the Hawksbury Rabbit District Order 1955.

(2) This order shall come into force on the day after the date of its notification in the Gazette.

  1. The boundaries of the Hawksbury Rabbit District, which was constituted by Order in Council, on the 3rd day of February 1953,* are hereby altered and redefined; and as from the commencement of this order, the boundaries of the said district shall be those specified in the Schedule hereto.

SCHEDULE

BOUNDARIES OF THE HAWKSBURY RABBIT DISTRICT

ALL that area in the Otago Land District, the Counties of Waikouaiti and Waihemo, and the Borough of Waikouaiti, containing 73,400 acres, more or less, bounded by a line commencing at Trigonometrical Station D, Hummock, in Hummock Survey District; thence generally south-easterly along the south-western boundaries of Runs 171C, 171G, and 171B, to the north-western boundary of Section 3, Block IX, Silverpeak Survey District; thence north-easterly along that boundary and the northern boundary of Section 21, Block VI, Waikouaiti Survey District, to and across Toomey Road to its eastern side; thence generally northerly along the eastern side of Toomey Road to the southern boundary of Hummockside Survey District; thence easterly along that boundary to the south-western boundary of Section 1, Block IV, Hummockside Survey District; thence north-westerly, north-easterly, and south-easterly along the south-western, north-western, north-eastern boundaries of that section to the north branch of the Waikouaiti River; thence to and generally south-easterly down the centre of that branch and the Waikouaiti River to its mouth; thence to and generally north-easterly along the mean high-water mark of the Pacific Ocean to the mouth of Stony Creek; thence generally north-westerly along the right bank of that creek to and along the northern side of a public road through Sections 11, 10, 8, 7, and 4, Block I, Hawksbury Survey District, and through Sections 1 of 64, 2 of 63, 1 of 63, 1 of 62, and 1 of 61, Block IV, Moeraki Survey District, to the southern boundary of the Borough of Palmerston; thence westerly and northerly along the southern and western boundaries of the Borough of Palmerston to Taieri Peak Road; thence generally westerly along the southern side of that road to the north-eastern corner of Lot 11, Deposited Plan 2449; thence southerly along a straight line to the junction of Mount Trotter Road and Mount Pleasant Road; thence generally westerly along the northern side of that road to a point in line with the eastern boundary of Lot 8, Deposited Plan 2194; thence generally southerly to and along the eastern boundaries of that Lot 8 and Lot 7, Deposited Plan 2193, to Mount Pleasant Road; thence south-westerly along the northern side of that road to the western boundary of Lot 7, Deposited Plan 2193; thence generally north-westerly along the western and south-western boundaries of the said Lots 7 and 8 to the north branch of the Waikouaiti River; thence to and north-westerly along the centre of that branch to a point in line with the southern boundary of Run 171E; thence westerly and north-easterly along the southern and north-western boundaries of Run 171E; thence south-westerly along the north-western boundaries of Runs 171D and 171C to the point of commencement.

Commission to Inquire into Accident at Renown Colliery

To all to whom these present shall come, and to: STANLEY LOGAN PATERSON, Esquire, Stipendiary Magistrate; JOHN LOWRIE, Underviewer; ANTONIO VALLI PRENDIVILLE, President of the United Mine Workers of New Zealand; REGINALD HUGO SCHOEN, Chief Inspector of Coal Mines; and THOMAS YOUNG, Mine Manager:

GREETING.

WHEREAS it is deemed expedient that inquiry should be made into the cause of the accident which occurred at the Renown Colliery on 31 August 1955, and matters incidental thereto:

Now, therefore, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, in exercise of the powers conferred on me by the Commissions of Inquiry Act 1908, and all other powers and authorities enabling me in this behalf, and acting by and with the advice and consent of the Executive Council, do hereby nominate, constitute, and appoint you, the said Stanley Logan Paterson, John Lowrie, Antonio Valli Prendiville, Reginald Hugo Schoen, and Thomas Young to be a Commission to inquire into and report upon—

(a) The cause of the accident:

(b) The nature and character of the working and the efficiency of the management of the mine:

(c) The efficiency of the inspection of the mine by all or any of the persons who are responsible for that inspection:

(d) Suggestions for the prevention, as far as possible, of similar accidents and for the safe working of this and other mines in the future—

and generally to inquire into and report upon such other matters arising thereout as may come to your notice in the course of your inquiries and which you consider should be investigated in connection therewith, and to report upon any matters affecting the premises which you consider should be brought to the attention of the Government, and in particular, to report your opinion whether any additional legislation is necessary and the scope of the same, and whether the regulations included in the existing law provide for reasonable and proper safeguards against similar accidents, or whether any amendment or addition to them is required:

And in exercise of such powers and authorities as aforesaid and with the like advice and consent I do hereby appoint you, the said Stanley Logan Paterson, to be the Chairman of the said Commission:

And for the better enabling you to carry these presents into effect you are hereby authorized and empowered to make and conduct any inquiry under these presents at such times and places as you deem expedient with power to adjourn from time to time and from place to place as you think fit, and so that these presents shall continue in force and the inquiry may at any time and place be resumed although not regularly adjourned from time to time or from place to place:

And you are hereby strictly charged and directed that you shall not at any time publish or otherwise disclose except to me in pursuance of these presents or by my direction the contents or purport of any report so made or to be made by you:

And it is hereby declared that the powers hereby conferred shall be exercisable notwithstanding the absence at any time of any one member of the Commission hereby appointed, so long as the Chairman and three other members be present and concur in the exercise of such powers:

And using all due diligence you are required to report to me in writing under your hands not later than the 9th day of December 1955 your findings and opinions on the matters aforesaid, together with such recommendations as you think fit to make in respect thereof:

Given in Executive Council under the hand of His Excellency the Governor-General this 21st day of September 1955.

Major G. J. Austin, M.B.E., E.D., is granted an extension of his short-service commission for a period of six months as from 2 July 1955.

Territorial Force

2nd Field Regiment, R.N.Z.A.

2nd Lieutenant T. G. Meachen is transferred to the 5th Light Regiment, R.N.Z.A. Dated 18 August 1955.

3rd Field Regiment, R.N.Z.A.

2nd Lieutenant A. P. Todd to be Lieutenant. Dated 19 December 1954.

5th Light Regiment, R.N.Z.A.

2nd Lieutenant T. G. Meachen from the 2nd Field Regiment, R.N.Z.A., to be 2nd Lieutenant with seniority from 28 August 1953. Dated 18 August 1955.

11th Coast Regiment, R.N.Z.A.

Captain S. H. Diehl, E.D., is posted to the Retired List. Dated 16 June 1955.

13th Composite Anti-Aircraft Regiment, R.N.Z.A.

The notice published in the N.Z. Gazette, 11 August 1955, No. 52, page 1261, is hereby cancelled, and the following substituted: Captain (temp. Major) I. G. Scott, E.D., is posted to the Retired List with the rank of Major. Dated 21 June 1955.
