(2) Where any bulk oatmeal or rolled oats to which this Order applies is sold by retail in a lot other than one of the lots specified in subclause (1) of this clause, the maximum price of the lot shall be the price of the nearest lower specified lot increased as follows :

(a) In the case of retailers to whom paragraph (a) of subclause (1) of this clause applies : By 1½d. a pound for oatmeal or 1s. 0½d. a pound for rolled oats (as the case may be) for each pound of the surplus :

(b) In the case of retailers to whom paragraph (b) of subclause (1) of this clause applies : By 1s. a pound for oatmeal or 1s. 1d. a pound for rolled oats (as the case may be) for each pound of the surplus.

(3) If in respect of any oatmeal or rolled oats sold by a retailer the maximum price calculated in accordance with the foregoing provisions of this clause is not an exact number of pence or half-pence, the maximum price of the lot may be increased to the nearest upward halfpenny.

SPECIAL PRICES WHERE EXTRAORDINARY CHARGES INCURRED

  1. Notwithstanding anything in the foregoing provisions of this Order, and subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any manufacturer, wholesaler, or retailer, may authorize special maximum prices in respect of any oatmeal or rolled oats to which this Order applies where special circumstances exist or for any reason extraordinary charges (freight or otherwise) are incurred by the manufacturer, wholesaler, or retailer. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of oatmeal or rolled oats or may relate generally to all oatmeal or rolled oats sold by the manufacturer, wholesaler, or retailer while the approval remains in force.
