Consenting to the Raising of Portion (£20,000) of the Wellington
City Council’s Loan of £435,200 and Prescribing the Conditions
Thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 21st day of
July 1954
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 7th day of June
1950 (hereinafter called the said Order in Council), and
subject to the determinations as to borrowing and repayment there-
in set out, consent was given to the raising by the Wellington City
Council (hereinafter called the said local authority) of a loan of
four hundred and thirty-five thousand two hundred pounds, to be
known as City Works Loan No. 2 1950 (hereinafter called the said
loan):

And whereas the authority conferred by the said Order in
Council has not yet been exercised to the extent of three hundred
and eighty thousand two hundred pounds :

And whereas the authority has lapsed in accordance with the
provisions of clause 7 of the said Order in Council and it is not now
lawful or competent for the said local authority to raise the said
amount of three hundred and eighty thousand two hundred pounds
or any portion thereof except in accordance with the provisions
of a further Order in Council that may be issued pursuant to section
11 of the Local Government Loans Board Act 1926 (hereinafter
called the said Act):

And whereas the said local authority is now desirous of raising
portion of the said loan amounting to twenty thousand pounds
(hereinafter called the said sum) and it is expedient to authorize
the said local authority to raise the said sum on the conditions
hereinafter set out :

Now, therefore, pursuant to section 11 of the said Act, as set
out in section 29 of the Finance Act 1932 (No. 2), His Excellency
the Governor-General, acting by and with the advice and consent
of the Executive Council, hereby consents to the raising in New
Zealand by the said local authority of the said sum up to the amount
of twenty thousand pounds for the purpose for which the said loan
was authorized, and in giving such consent hereby determines as
follows :

  1. The term for which the said sum or any part thereof may
    be raised shall be ten years.

  2. The rate of interest that may be paid in respect of the said
    sum or any part thereof shall be such as shall not produce to the
    lender or lenders a rate or rates exceeding four per cent per annum.

  3. The said sum or any part thereof shall be repaid by the
    annual redemption of debentures in the years set out in the first
    column of the Schedule hereunder of the amounts stated opposite
    each such year in the second column of the said Schedule.

  1. The payment of interest and redemptions in respect of the
    said sum shall be made in New Zealand.

  2. No amount payable either as interest or as a redemption
    in respect of the said sum shall be paid out of loan money.

  3. The rate payable for brokerage, underwriting, and procura-
    tion fees in respect of the raising of the said sum or any part thereof
    shall not in the aggregate exceed one-half per cent of any amount
    raised.

  4. No money shall be borrowed under this consent after the
    expiration of two years from the date hereof.

Varying the Determinations in Respect of Portion (£90,000) of the
Wellington City Council’s Loan of £135,000

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 2nd day of June
1954 (hereinafter called the said Order in Council), and
subject to the determinations as to borrowing and repayment
therein set out, consent was given to the raising in New Zealand
by the Wellington City Council (hereinafter called the said local
authority) of a loan of one hundred and thirty-five thousand pounds,
to be known as Transport Loan 1953 (hereinafter called the said
loan) :

And whereas the said loan has not yet been raised and it is
expedient to vary certain of the determinations aforesaid in respect
of a portion thereof amounting to ninety thousand pounds (herein-
after called the said sum) :

Now, therefore, pursuant to section 11 of the Local Govern-
ment Loans Board Act 1926, as set out in section 29 of the Finance
Act 1932 (No. 2), His Excellency the Governor-General, acting by
and with the advice and consent of the Executive Council, hereby
varies certain of the determinations aforesaid in respect of the
said sum by prescribing that in lieu of repayment in the manner
prescribed in clause 3 of the said Order in Council, the said sum or
any part thereof shall be repaid by the annual redemption of deben-
tures in the years set out in the first column of the Schedule here-
under of the amounts stated opposite each such year in the second
column of the said Schedule.

Officer Authorized to Take Statutory Declarations

PURSUANT to section 301 of the Justices of the Peace
Act 1927, His Excellency the Governor-General hereby
authorizes John Thomas Fleming, being Assistant District
Commissioner of Taxes, Wellington, to take and receive
statutory declarations under that section.

As witness the hand of His Excellency the Governor-
General, this 30th day of July 1954.

PURSUANT to section 16 of the New Zealand Army Act
1950, His Excellency the Governor-General has been
pleased to approve of the following appointments, promotions,
transfers, resignations, and retirements of officers of the
New Zealand Army:

THE ROYAL N.Z. ARTILLERY

Regular Force

Major Alan Mervyn Smith, E.D., from the 9th Coast
Regiment, R.N.Z.A., is granted a short service commission for
a period of eighteen months as from 2 July 1954 in the rank
of Major, and is appointed United Nations Military Observer
with the Palestine Truce Supervision Organization. Dated
2 July 1954.

Captain (temp. Major) Geoffrey James Austin, M.B.E.,
E.D., from the 1st Locating Battery, R.N.Z.A., is granted a
short service commission for a period of one year as from
2 July 1954 in the rank of Major, and is appointed United
Nations Military Observer with the Palestine Truce Supervision
Organization. Dated 2 July 1954.

3rd Field Regiment, R.N.Z.A.

Lieutenant A. W. F. Davey is attached to the South
Otago High School Cadets in addition to his appointment with
