Notice to Persons Affected by Applications for Licences
Under Part III of the Industrial Efficiency Act 1936

Pharmacy Industry

W. H. Teape, 59 River Road, Avonside, Christchurch,
has applied for a licence to operate a new pharmacy at
Selwyn Street, Timaru.

Retail Sale and Distribution of Motor Spirit

Austin Motors (Otago) Ltd., 482–490 Princes Street,
Dunedin, has applied for a licence to resell motor spirit from
one pump to be installed on service-station and garage
premises at corner of Jervois and Bond Streets, Dunedin.

East Tamaki Co-op. Dairy Co. Ltd., Great South Road,
Takanini, has applied for a licence to resell motor spirit
from one pump to be installed on factory premises at
Great South Road, Takanini, supplies to be restricted to
shareholders.

Kleenman and Bishop Ltd., Broadway, Stratford, has
applied for permission to shift five pumps from their present
position at garage premises, Broadway, Stratford, to a new
site on service station facing Miranda Street, Stratford.

Tauhei Stores Ltd., Tauhei, R.D., has applied for per-
mission to take over motor spirits retail licence for one pump
from K. Rowling, and to shift the pump to a new site
approximately 100 yards from the present position at Tauhei.

Applicants and other persons considering themselves to
be materially affected by the decisions of the Bureau of
Industry on these applications should, not later than 24
June 1954, submit any written evidence and representations
they may desire to tender. All communications should be
addressed to Secretary, Bureau of Industry, C.P.O. Box
2492, Wellington.

Price Order No. 1554 (Raw-leaf Tobacco)

PURSUANT to the Control of Prices Act 1947, the Price
Tribunal hereby makes the following Price Order:

  1. This Order may be cited as Price Order No. 1554,
    and shall come into force on the 11th day of June 1954.

  2. In this Order—

‘‘ Flue-cured leaf ’’ means leaf that has been treated in
the kiln for at least three successive days immediately
after picking for the purpose of yellowing, fixing
colour, drying, and drying mid-ribs:

‘‘ Air-dried leaf ’’ means leaf other than flue-cured
leaf:

‘‘ Raw tobacco.’’ means unmanufactured tobacco, and
includes the leaves and stems of the tobacco plant
before they have passed through any process of
manufacture other than curing:

‘‘ Sale ’’ includes a contract for sale, agreement to
sell, and offer for sale; ‘‘ purchase ’’ includes
a contract for purchase, agreement to purchase, and
offer to purchase; and ‘‘ sale ’’ and ‘‘ purchase ’’
include barter and exchange.

APPLICATION OF THIS ORDER

  1. This Order applies with respect to all raw-leaf tobacco
    grown in New Zealand during the 1953–54 season: Provided
    that the Tribunal may, in any case where it considers it
    proper to do so and subject to such conditions (if any) as
    it thinks fit, exempt any such tobacco from the operation of
    this Order.

FIXING AVERAGE PRICES OF RAW-LEAF TOBACCO TO WHICH
THIS ORDER APPLIES

  1. (1) The average price to be paid by any tobacco
    manufacturer for raw-leaf tobacco to which this Order applies
    shall be not less than—

(a) For flue-cured leaf: 3s. 10½d. per pound.

(b) For air-dried leaf: 3s. 7½d. per pound.

(2) For the purpose of this clause the weight of any
raw-leaf tobacco shall be deemed to be its weight at the time
and place of delivery by the grower to the manufacturer or
to his agent in the district in which it is grown: Provided,
that in any case where the grower and the manufacturer or
his agent agree that the moisture-content of the leaf in any
lot of tobacco is excessive, then, for the purposes of calculating
the value of the lot, the weight of the lot shall be deemed to
be reduced by a reasonable amount to make allowance for the
excessive moisture.

  1. No raw tobacco shall be sold by the grower thereof
    or purchased from him at less than 1s. 6d. per pound free on
    board ship Motueka or Nelson in the case of tobacco grown
    in the Nelson Provincial District, and in the case of tobacco
    grown in any other district at less than 1s. 6d. per pound
    free on board ship or free on rail at the port or railway-
    station which is nearest to the place at which such tobacco is
    grown.

  2. No raw tobacco shall be sold by any person other than
    the grower thereof, or purchased from such other person at
    less than 1s. 6d. per pound free on board ship or free on
    rail at the port or railway-station which is nearest to the
    place at which such tobacco is at the time of sale thereof being
    held or stored.

  3. Notwithstanding anything in the provisions of clauses
    5 and 6 hereof, the Tribunal may, in any case where it con-
    siders it proper so to do, authorize the sale and purchase of
    tobacco at a price less than the price fixed by either of those
    clauses.
