Revocation of Order in Council which Required the Coromandel County Council to Prepare an Extra-urban Planning Scheme for the Whitianga Township Area

At the Government House at Wellington, this 11th day of February 1953
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
WHEREAS the Coromandel County Council is the responsible authority within the meaning of the Town-planning Act 1926 of a certain rural area as defined in the said Act—namely, the Coromandel County:
And whereas by the Order in Council referred to in the Schedule hereto the Coromandel County Council was required, pursuant to section 25 of the said Act, to prepare and submit to the Town-planning Board an extra-urban planning scheme in respect of a certain defined area within the rural area aforesaid—namely, the defined area described in the Schedule to the Order in Council referred to in the Schedule hereto:
And whereas the Coromandel County Council has now requested that the said Order in Council be revoked and His Excellency the Governor-General is of opinion that effect should be given to the request of the said Council:
Now, therefore, in pursuance and exercise of the powers conferred upon him by paragraph (h) of section 25 of the Acts Interpretation Act 1924, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby revoke the Order in Council referred to in the Schedule hereto.

Revoking a Licence Authorizing Felix Patrick Anthony Campbell, of Havelock North, Farmer, to use Water for the Purpose of Generating Electricity, and to Erect Certain Electric Lines

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and with the consent of the licensee, hereby revokes the Order in Council dated the 17th day of September 1923, and published in the Gazette on the 20th day of the same month, authorizing William Van Asch, of Havelock North, Farmer, to use water for the purpose of generating electricity and to erect certain electric lines, the rights, powers, and privileges under the said Order in Council having been assigned to Felix Patrick Anthony Campbell, of Havelock North, Farmer.

Authorizing Stephen Noel Gilmour and Joseph Collins Gilmour, Both of Whangamomona, Farmers, to Erect and Use Certain Electric Lines in the County of Whangamomona

ORDER IN COUNCIL

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL
PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes Stephen Noel Gilmour and Joseph Collins Gilmour, both of Whangamomona, Farmers (hereinafter referred to as the licensees), subject to the conditions hereinafter set forth, to lay, construct, put up, place, and use the electric lines described in the Schedule hereto.
CONDITIONS
IMPLIED CONDITIONS

  1. The conditions directed to be implied in all licences by the Electrical Supply Regulations 1935 and the Electrical Wiring Regulations 1935, shall be incorporated in and shall form part of this licence except in so far as the same may be inconsistent with the provisions hereof.
    LICENCE SUBJECT TO REGULATIONS
  2. In respect of the electric lines hereby authorized, the licensees shall comply with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with all regulations hereafter made in amendment thereof or in substitution therefor respectively.
    SYSTEM OF SUPPLY
  3. The system of supply shall be as described in paragraph (d) of regulation 21–01 of the Electrical Supply Regulations 1935, and shall be an alternating-current system.
    DURATION OF LICENCE
  4. Unless sooner lawfully determined this licence shall continue in force until the 31st day of March 1973, or until electrical energy is available from an Electric-power Board or some other public source of supply, whichever is the earlier.
    SCHEDULE
    LINES for the supply of electrical energy by the system of supply hereinbefore described, commencing from the licensees’ generator situated in Lot 2, D.P. 6674, and proceeding as follows :
    (a) In a northerly direction to a house situated in the said Lot 2.
    (b) In a northerly direction to a slaughterhouse situated in Lot 1, D.P. 6674.
    (c) In a southerly direction generally to and across a road reserve and the Whangamomona Stream, thence south-westerly and south-easterly across Subsection l of Section 165 to a house situated in Subsection 2 of Section 165.
    All being situated in Block I, Mahoe Survey District, in the County of Whangamomona.
    The said lines being more particularly shown by means of red lines on the plan marked S.H.D. 221, deposited in the office of the Minister in Charge of the State Hydro-electric Department.

    Officer Authorized to Take and Receive Statutory Declarations

    PURSUANT to the authority conferred upon me by section 301 of the Justices of the Peace Act 1927, I Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, do hereby notify and declare that John Milne Checketts, D.S.O., D.F.C., being an officer in the service of the Crown holding the office of Wing Commander, Taieri, is authorized to take and receive statutory declarations under section 301 of the Justices of the Peace Act 1927.
    As witness the hand of His Excellency the Governor-General, this 13th day of February 1953.

    Honorary Inspector of Scenic Reserves Appointed

    PURSUANT to section 4 of the Scenery Preservation Act 1908, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby appoint Nihwa Te Pou to be an Honorary Inspector under the said Act.
    As witness the hand of His Excellency the Governor-General, this 12th day of February 1953.

    Lands Reserved in the North Auckland and South Auckland Land Districts

    WHEREAS by section 167 of the Land Act 1948 it is enacted that the Governor-General may from time to time set apart as a reserve, notwithstanding that the same may be then held under pastoral lease or pastoral occupation licence, any Crown land for any purpose, which, in his opinion, is desirable in the public interest, and notice thereof shall be published in the New Zealand Gazette : Now, therefore, pursuant to section 167 of the said Act, I, Lieutenant-General Sir Charles Willoughby Moke Norrie, the Governor-General of New Zealand, hereby reserve, subject to the reservations and conditions imposed by section 59 of the Land Act 1948, the lands in the North Auckland and South Auckland Land Districts described in the Schedule hereunder written, for the purposes specified at the end of the respective descriptions of the lands so intended to be reserved.

    ALL that area situated in Block XII, Waitemata Survey District, containing by admeasurement 10·8 perches, more or less, being Allotment 360, Parish of Takapuna, being part of the land comprised and described in certificate of title, Volume 789, folio 155 (Auckland Registry).
