Revoking in Part an Order in Council Taking Land for Drainage Purposes and Road Works in Rarotonga, Cook Islands, Part of Such Land Not Being Required for Those Purposes

At the Government Buildings at Wellington, this 3rd day of August 1953

Present:
THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

Pursuant to section 358 of the Cook Islands Act 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby revokes in part the Order in Council made on the 25th day of November 1912 and published in the Cook Islands Gazette on the 19th day of December 1912, at page 480, taking certain land (described in the Schedule hereto) for drainage purposes and road works, that is to say, the said Order in Council is hereby revoked except as to Allotment 161 and portion of the Allotments 162 and 175 as the same are described in the said Schedule, the land so taken, except as aforesaid, having been found not to be required for the purpose for which it was taken.

SCHEDULE

All that piece of land, being Allotment 161 and part of Allotments 71, 72, and 43, District of Avarua, Island of Rarotonga, starting at a point on the Takuvaine Creek 140 meters south of the bridge on the Main Road; thence easterly along the centre-line of the land 225 meters to the eastern side of the Mission Road, taking 10 meters in width on each side of this line; thence northerly 56 meters; thence easterly along the southern boundaries of Allotments 43, 141, 140, 142, 143, 146, 146B, 147, 148, and 149A, a distance of 330 meters to the Residency Road; thence southerly along the Residency Road 160 meters to the Ara Metua; thence south-westerly along the Ara Metua 85 meters; thence along the northern boundaries of Allotments 180A, 184, 185, and 43 a distance of 260 meters to the Mission Road; thence northerly along the Mission Road 60 meters. Also all that piece of land portion of Allotments 162, 175, 176, 187H, and 187D starting from the Residency Road at a point 55 meters south from Allotment 149A; thence easterly along the centre-line of the land 320 meters to the Ara Metua, taking 10 meters in width on each side of this line.

Pursuant to the Industrial Societies Act 1908, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby incorporates the members of the Motueka District Tobacco Growers Association into a body corporate under the said Act, on and from the date of this order, by the style of “The Motueka District Tobacco Growers Association (Incorporated).”

The Western Side of Portion of Cuba Street in the City of Wellington Exempted from the Provisions of Section 128 of the Public Works Act 1928

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the following resolution passed by the Wellington City Council on the 14th day of February 1951 in so far as it affects the side and portion of street described in the Schedule hereto, viz.: “The Wellington City Council being the local authority having control of the streets in Wellington City, by the resolution declares that the provisions of section 128 of the Public Works Act 1928 shall not apply to the western side of the portion of Cuba Street adjoining Lots 1 and 2, D.P. 5170, being all (or part) of the land in certificates of title, Volume 280, folio 196, Volume 282, folio 201, Wellington Registry.”

SCHEDULE

The western side of all that portion of street situated in the Wellington Land District, City of Wellington, known as Cuba Street, fronting part of Town Section 176 and being Lot 2, D.P. 5170, being all the land comprised and described in certificate of title, Volume 280, folio 196 (Wellington Land Registry).

As the same is more particularly delineated on the plan marked P.W.D. 140839, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Pursuant to section 149 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby consents to the Waitemata County Council stopping the portions of road described in the Schedule hereto.

Authorizing the Laying-off of a Street off Wansbeck Street in the Borough of Oamaru, of a Width Less than 66 ft., but Not Less than 50 ft., Subject to a Condition as to the Building Line

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

Pursuant to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Oamaru Borough Council to lay off the proposed street described in the Schedule hereto, at a width for part of its length of less than 66 ft. but not less than 50 ft., subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said street within a distance of 40 ft. from the centre line of the said street.

SCHEDULE

That proposed street in the Otago Land District, Borough of Oamaru, containing by admeasurement 1 acre 1 rood 31·7 perches, more or less, being part Lot 42, D.P. 7658, being part Reserve D, Town of Oamaru (Borough of Oamaru). (Otago R.D.)
