Varying the Determinations in Respect of the Cromwell Borough Council’s Loan of £1,200

ORDER IN COUNCIL
At the Government House at Wellington, this 1st day of October 1952
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
WHEREAS by Order in Council made on the 15th day of August 1951 (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Cromwell Borough Council (hereinafter called the said local authority) of a loan of one thousand two hundred pounds (£1,200) to be known as “Fire Engine Loan 1951” (hereinafter called the said loan):
And whereas the said loan has not yet been raised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan :
Now, therefore, pursuant to section 11 of the Local Government Loans Board Act 1926, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby varies certain of the determinations aforesaid in respect of the said loan by prescribing that in lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause 3 of the said Order in Council, the said local authority shall, before raising the said loan or any part thereof, make provision for the repayment thereof by establishing a sinking fund under the Local Bodies' Loans Act 1926, or under such other statutory enactment as may be applicable, and shall thereafter make payments to such sinking fund at intervals of not more than one year at a rate or rates per centum which shall be not less than five pounds seven shillings and sixpence (£5 7s. 6d.), such payments to be made in respect of every part of the said loan for the time being so borrowed and not repaid, the first such payment to be made not later than one year after the first day from which interest to the lender or lenders is computed on the said loan or any part thereof so raised.

Varying the Determinations in Respect of the Napier City Council's Loan of £5,500 by Extending the Term Within Which the Said Loan May be Raised

Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
WHEREAS by Order in Council made on the 18th day of October 1950 (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Napier City Council (hereinafter called the said local authority) of a loan of five thousand five hundred pounds (£5,500) to be known as “Town Planning (Thackeray Street) Loan 1950”:
And whereas the said loan has not yet been raised and it is expedient to vary the determinations aforesaid in respect of the said loan by extending the period within which the said loan or any portion thereof may be raised:
Now, therefore, pursuant to section 11 of the Local Government Loans Board Act 1926, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby varies the determinations aforesaid in respect of the said loan by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of three (3) years from the date thereof.

Revoking the Reservation Over a Reserve in Block VII, Mangawhero Survey District, Wellington Land District

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL
PURSUANT to subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act 1928, His Excellency the Administrator of the Government, acting by and with the advice and consent of the Executive Council, hereby revokes the reservation for a site for a roadman's whare over the land described in the Schedule hereto, and hereby declares that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act 1948.
