ORDER IN COUNCIL
At the Government Buildings at Wellington, this 16th day of June 1952

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
WHEREAS by section 30 of the Rabbit Nuisance Act 1928 it is enacted that the Governor-General may, by Order in Council, on petition in that behalf signed by a majority of the persons qualified to be enrolled on the ratepayers’ list for any proposed district, constitute and declare any area of land of not less than 1,000 acres a rabbit district under and for the purposes of Part II of the said Act:
And whereas, in pursuance of the provisions of the said section 30 of the said Act, a petition has been received praying that the area of land described in the Schedule hereto be constituted and declared a rabbit district under and for the purposes of Part II of the said Act:
And whereas the said petition is signed by a majority of the persons in the said area of land qualified to be enrolled on the ratepayers’ list for the said proposed district, and it is deemed expedient to give effect to the prayer of the petitioners accordingly:
Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby constitutes by the specific name of the “Te Puke Rabbit District” and declares that area of land defined in the Schedule hereto to be a rabbit district under and for the purposes of Part II of the said Act; and doth hereby further declare that the basis on which the Board to be established for the said district shall first levy its general rate shall be on the basis of the acreage of the rateable property in the said district.
SCHEDULE
BOUNDARIES OF THE TE PUKE RABBIT DISTRICT
ALL that area of approximately 42,800 acres in the South Auckland Land District, situated in the County of Tauranga, bounded by a line commencing at a point on the shores of the Bay of Plenty in Block I, Te Tumu Survey District, being the northernmost corner of Papamoa No. 2 Section 7B Block, and running south-easterly generally along the shores of the Bay of Plenty aforesaid to the right bank of the Kaituna River; thence westerly generally up the right bank of the Kaituna River aforesaid to a point in line with the western boundary of part of Tumu Kaituna No. 1 Block as shown on the plan numbered 16773, deposited in the Auckland Land Registry Office; thence along a right line across the Kaituna River aforesaid to and along the middle of Belts Road to the middle of the Paeroa–Whakatane State Highway; thence southerly generally along the middle of that highway to a point in line with the northern boundary of the Borough of Te Puke as described in the New Zealand Gazette No. 25 of the 11th day of April 1935, page 1047; thence along a right line to and along the northern, eastern, and southern boundaries of the aforesaid borough, to and up the middle of the Ohineangaanga Stream to a point in line with the northern boundary of Section 18 of Block VI, Maketu Survey District; thence along a right line to and along the northern and north-eastern boundaries of Section 18 aforesaid and along a right line, being the last-mentioned boundary produced, to the middle of No. 2 Road; thence along the middle of that road and along the middle of the road forming the eastern boundary of Section 46 of Block IX, Maketu Survey District, and along a right line, being the last-mentioned middle-line produced, to the middle of the Mangatoi Stream; thence westerly generally up the middle of that stream to and along the northern boundaries of Sections 5 and 4 of Block XVI, Otanewainuku Survey District, to the north-western corner of section 4 aforesaid; thence northerly generally along the eastern boundaries of Waoku No. 2 and 2B Blocks, the eastern and northern boundaries of Waoku No. 2A Block, to and along the eastern boundaries of Lot 11 and part Lot 10 as shown on the plan numbered 1042, deposited as aforesaid, being part Waitaha No. 2 Block, and along a right line, being the last-mentioned boundary produced, to the middle of the Waitao Stream; thence down the middle of the Waitao Stream aforesaid to and along the middle of the Paeroa-Whakatane State Highway, to and along the middle of Otaimatua Road, to and along the middle of the Papamoa – Mount Maunganui Main Righway to a point in line with the north-western boundary of Papamoa No. 2 Section 7B Block; thence along a right line to and along the aforesaid north-western boundary to the point of commencement.
