Declaring Portion of Fenham Road in the Wallace County to be County Road

ORDER IN COUNCIL
At the Government House at Wellington, this 21st day of May 1952
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 112 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby orders and declares that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become county road.

SCHEDULE

ALL that portion of road in the Southland Land District, Wallace County, known as Fenham Road, commencing at a point 60 chains from its intersection with the Argyle–Tuatapere Main Highway and proceeding thence in a north-easterly direction for a distance of 28 chains, more or less, adjoining parts Section 7, Block XII, Waiau Survey District.

As the same is more particularly delineated on the plan marked P.W.D. 135926, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby directs the sale of the land described in the Schedule hereto, such land being no longer required for the purpose for which it was acquired.

SCHEDULE

APPROXIMATE area of the piece of land directed to be sold : 4·4 perches.
Being part Lot 2, D.P. 12395 and being part Section 73, Town of Foxton.

Situated in Block V, Mount Robinson Survey District (Borough of Foxton). (S.O. 22593.)

In the Wellington Land District ; as the same is more particularly delineated on the plan marked P.W.D. 137081, deposited in the office of the Minister of Works at Wellington, and thereon coloured blue.

PURSUANT to the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby directs the sale of the land described in the Schedule hereto, such land being no longer required for the public work for which it was taken.

SCHEDULE

APPROXIMATE area of the piece of land : 0·6 of a perch.
Being part railway land in Proclamation 2302.

Situated in Block XVI, Otamatea Survey District, Rodney County. (S.O. 26337 and S.O. 13995.)

In the North Auckland Land District : as the same is more particularly delineated on the plan marked L.O. 11519, deposited in the office of the Minister of Railways at Wellington, and thereon coloured red.

The South-eastern Side of Portion of an Unnamed Street, in the Borough of Queenstown, Exempted From the Provisions of Section 128 of the Public Works Act 1928

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 128 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby approves of the following resolution passed by the Queenstown Borough Council on the 3rd day of December 1951, in so far as it affects the side and portion of street described in the Schedule hereto, viz.—

“The Queenstown Borough Council, being the local authority having control of the streets in the Borough of Queenstown, by resolution declares that the provisions of section 128 of the Public Works Act 1928, shall not apply to the south-east side of the portion of narrow street adjoining Sections 1, 2, 6, 7, 8, and 9, Block XXX, Town of Queenstown, being all the land in certificates of title, Volume 3, folio 260, Volume 34, folio 32, and Volume 222, folio 70, Otago Registry.”

SCHEDULE

THE south-eastern side of all that portion of an unnamed street situated in the Otago Land District, Borough of Queenstown, fronting Sections 6 and 7, Block XXX, Town of Queenstown. As the same is more particularly delineated on the plan marked P.W.D. 136556, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Consenting to the Raising of Loans of £25,700 and £23,700 by the Christchurch City Council and Prescribing the Conditions Thereof

ORDER IN COUNCIL
At the Government House at Wellington, this 14th day of May 1952
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the Christchurch City Council (hereinafter called the said local authority), being desirous of raising the respective loans set out in the first column of the Schedule hereto, has complied with the provisions of the Local Government Loans Board Act 1926 (hereinafter called the said Act), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans :

Now, therefore, pursuant to section 11 of the said Act, as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council hereby consents to the raising in New Zealand by the said local authority of the respective loans set out in the first column of the said Schedule, up to the respective amounts specified in the second column of the said Schedule, and in giving such consent hereby determines as follows :—

  1. The terms for which the said loans or any parts thereof may be raised shall be the respective terms (in years) stated in the third column of the said Schedule.

  2. The rates of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding the respective rates per centum per annum stated in the fourth column of the said Schedule.

  3. The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in 1 above.

  4. The payment of such instalments shall be made in New Zealand and no such instalment shall be paid out of loan-moneys.

  5. No amount shall be payable for brokerage, underwriting, or procurement fees in respect of the raising of the said respective loans or any parts thereof.

  6. No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
