Government Orders in Council




  1. The payment of such instalments shall be made in New Zealand and no instalments shall be paid out of loan-moneys.
  2. The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one half per centum of any amount raised.
  3. No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in Respect of the Balance (£1,000) of the Wairoa Electric-power Board's Loan of £5,000

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
WHEREAS by Order in Council made on the 10th day of April 1951 (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Wairoa Electric-power Board (hereinafter called the said local authority) of a loan of five thousand pounds (£5,000) to be known as "Reticulation Loan No. 2 1948" (hereinafter called the said loan):
And whereas the authority conferred by the said Order in Council has not been exercised to the extent of one thousand pounds (£1,000) (hereinafter called the said sum), and it is expedient to vary certain of the determinations aforesaid in respect of the said sum :
Now, therefore, pursuant to section 11 of the Local Government Loans Board Act 1926 as set out in section 29 of the Finance Act 1932 (No. 2), His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby varies certain of the determinations aforesaid in respect of the said sum by prescribing that in lieu of provision being made for the repayment of the said sum by the establishment of a sinking fund in respect thereof, as specified in clause (3) of the said Order in Council, the said local authority shall raise the said sum or any portion thereof, upon terms of making the same, together with interest thereon, repayable by equal aggregate annual or half-yearly instalments extending over the term of twenty (20) years, as specified in clause (1) of the said Order in Council.

Authorizing the Laying-off of Streets in the Borough of Upper Hutt Subject to Conditions as to the Building-line

At the Government Buildings at Wellington, this 24th day of March 1952
Present:
THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL
PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Upper Hutt Borough Council to permit the laying-off of the proposed streets described in the Schedule hereto, to be known as McCurdy, Robertson, Massey, Rongonui, McLeod, and Redwood Streets and Fraser Crescent, at widths for the whole of their lengths of less than 66 ft. but, in respect of McCurdy, Robertson, Massey, and Rongonui Streets, not less than 40 ft., in respect of McLeod Street and that part of Fraser Crescent shown coloured yellow on the plan marked P.W.D. 136682 referred to in the said Schedule not less than 50 ft., and in respect of Redwood Street and that part of Fraser Crescent shown coloured red on the said plan not less than 60 ft., subject to the condition that no building or part of a building shall at any time be erected on Lot 27 of a subdivision of the land shown edged green on the said plan, within a distance of 35 ft. from the centre-line of McCurdy Street, on Lot 136 of the said subdivision within a distance of 35 ft. from the centre-line of Rongonui Street, on Lot 116 of the said subdivision within a distance of 38 ft. from the centre-line of Rongonui Street, on Lot 99 of the said subdivision within a distance of 40 ft. from the centre-line of Redwood Street, or on the balance of the land shown edged green on the said P.W.D. plan within a distance of 48 ft. from the centre-lines of the said streets.

SCHEDULE
Those proposed streets in the Wellington Land District, Borough of Upper Hutt, containing by admeasurement 7 acres 2 roods 12.78 perches, more or less, being part Sections 117 and 118, Hutt District.
As the same are more particularly delineated on the plan marked P.W.D. 136682, deposited in the office of the Minister of Works at Wellington, and thereon coloured red and coloured yellow.

PURSUANT to section 31 of the Municipal Corporations Amendment Act 1948 and section 125 of the Public Works Act 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby authorizes the Thames Borough Council to lay off the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 ft., but not less than 46 ft., subject to the condition that no building or part of a building shall at any time be erected on Lot 12 of a subdivision of the land shown edged green on the plan marked P.W.D. 136650, referred to in the said Schedule, and fronting the proposed street within a distance of 33 ft. from the centre-line of the said street, or on the remainder of the land in the said subdivision fronting the proposed street within a distance of 48 ft. from the centre-line of the said street.

SCHEDULE
THAT proposed street in the South Auckland Land District, Borough of Thames, to be known as Price Avenue, containing by admeasurement 1 rood 29.9 perches, more or less, being part Kauaeranga E No. 13 Block. As the same is more particularly delineated on the plan marked P.W.D. 136650, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

The Hawke's Bay Metropolitan Milk Board Constitution Order 1952

Present:

PURSUANT to the Milk Act 1944, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following Order.
ORDER

  1. This Order may be cited as the Hawke's Bay Metropolitan Milk Board Constitution Order 1952.
  2. The Milk Authority of the Hawke's Bay Metropolitan Milk District (as constituted by the Hawke's Bay Metropolitan Milk District Constitution Order 1952) shall be a Metropolitan Milk Board, to be known as the "Hawke's Bay Metropolitan Milk Board" (hereinafter referred to as the Board).
  3. (1) The Board shall, subject to the provisions of section 20 of the Milk Act 1944, consist of seven representatives of the constituent districts within the said milk district.
    (2) The number of representatives of each constituent district shall be the number specified in the Schedule hereto opposite the name of the constituent district.
  4. The first election of members of the Board shall be held on the 23rd day of April 1952; and for the purposes of that election the following provisions shall apply:-
    (a) The Town Clerk of the City of Napier shall be the Returning Officer:
    (b) The offices of the Napier City Council shall be deemed to be the offices of the Board:
    (c) Subclause (1) of regulation 7 of the Milk Board Election Regulations 1945* shall be read as if the words "twenty-one days" were substituted for the words "forty-two days", and as if the words "fourteen days" were substituted for the words "twenty-one days", and as if the words "ten days" were substituted for the words "seventeen days":
    (d) Regulation 9 of the said regulations shall be read as if the words "seven days" were substituted for the words "fourteen days".
