Consenting to the Raising of the Balance (£7,920) of the Waipawa
County Council’s Loan of £20,000 and Prescribing the Conditions
Thereof

ORDER IN COUNCIL

At the Government House at Wellington, this 17th day of
October 1951

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Order in Council made on the 7th day of May,
1947, and subject to the determinations as to borrowing and
repayment therein set out, consent was given to the raising by the
Waipawa County Council (hereinafter called the said local authority)
of the sum of twelve thousand nine hundred and twenty pounds
(£12,920) being the balance then unraised of a loan of twenty thousand
pounds (£20,000) known as “Bridges Loan 1939” (hereinafter
called the said loan):

And whereas the authority conferred by the said Order in
Council has not yet been exercised to the extent of seven thousand
nine hundred and twenty pounds (£7,920):

And whereas the authority has lapsed in accordance with the
provisions of clause (6) of the said Order in Council, and it is not
now lawful or competent for the said local authority to raise the
balance of the said loan or any portion thereof, except in accordance
with the provisions of a further Order in Council that may be issued
pursuant to section 11 of the Local Government Loans Board Act
1926 (hereinafter called the said Act):

And whereas the said local authority is now desirous of raising
the balance of the said loan amounting to seven thousand nine
hundred and twenty pounds (£7,920) (hereinafter called the said
sum) and it is expedient to authorize the said local authority to
raise the said sum or any portion thereof on the conditions herein-
after set out:

Now, therefore, pursuant to section 11 of the said Act, as set
out in section 29 of the Finance Act 1932 (No. 2), His Excellency
the Governor-General, acting by and with the advice and consent
of the Executive Council, hereby consents to the raising in New
Zealand by the said local authority of the said sum up to the amount
of seven thousand nine hundred and twenty pounds (£7,920) for the
purpose for which the said loan was authorized, and in giving such
consent hereby determines as follows:—

(1) The term for which the said sum or any part thereof may
be raised shall not exceed twenty-five (25) years.

(2) The rate of interest that may be paid in respect of the said
sum or any part thereof shall be such as shall not produce to the
lender or lenders a rate or rates exceeding three pounds five shillings
(£3 5s.) per centum per annum.

(3) The said sum or any part thereof, together with interest
thereon, shall be repaid by equal aggregate annual or half-yearly
instalments extending over the term as determined in (1) above.

(4) The payment of such instalments shall be made in New
Zealand, and no such instalments shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and pro-
curation fees in respect of the borrowing of the said sum or any part
thereof shall not in the aggregate exceed one-half per centum of any
amount raised.

(6) No moneys shall be borrowed under this consent after the
expiration of two years from the date hereof.

Lands Reserved in the Wellington, Nelson, and Otago Land Districts

WHEREAS by section 167 of the Land Act 1948, it is enacted
that the Governor-General may from time to time set apart
as a reserve, notwithstanding that the same may be then held under
pastoral lease or pastoral occupation licence, any Crown land for
any purpose, which, in his opinion, is desirable in the public interest,
and notice thereof shall be published in the New Zealand Gazette:

Now, therefore, pursuant to section 167 of the said Act, I,
Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-
General of New Zealand, hereby reserve, subject to the reservations
and conditions imposed by section 59 of the Land Act 1948, and
subject also to the reservations imposed by section 8 of the Coal
Mines Amendment Act 1950, the lands in the Wellington, Nelson,
and Otago Land Districts described in the Schedule hereunder
written, for the purposes specified at the end of the respective
descriptions of the lands so intended to be reserved.

Officer Authorized to Take and Receive Statutory Declarations

PURSUANT to the authority conferred upon me by section 301
of the Justices of the Peace Act 1927, I, Lieutenant-General
Sir Bernard Cyril Freyberg, the Governor-General of the Dominion
of New Zealand, do hereby notify and declare that Thomas Reginald
Frazer, being an officer in the service of the Crown holding the office
of Trust Officer at Timaru, is authorized to take and receive statutory
declarations under section 301 of the Justices of the Peace Act 1927.

As witness the hand of His Excellency the Governor-General,
this 19th day of October 1951.

Appointments in the Royal New Zealand Navy

HIS Excellency the Governor-General has been pleased to
approve the following appointments in the Royal New
Zealand Navy:—

Commander (E) Francis Stuart Ferguson, R.N., lent Royal
New Zealand Navy and appointed H.M.N.Z.S. “Maori”, additional,
for 2½ years’ Loan Service, to date 29 November 1951, and
H.M.N.Z.S. “Philomel”, additional, for passage and for duty
inside Navy Office and as Director of Naval Engineering, vice
Commander (E) E. A. G. Whittle (date to be reported).

Lieutenant William Bernard Elliott, R.N., transferred to the
Royal New Zealand Navy, to date 19 August 1951, in the rank of
Lieutenant, with seniority of 10 January 1944.

Lieutenant Peter Donald Cox, R.N., lent Royal New Zealand
Navy and appointed H.M.N.Z.S. “Maori”, additional, for 2½
years’ Loan Service, to date 7 September 1951, and H.M.N.Z.S.
“Philomel”, additional, for passage (date to be reported).

Lieutenant James Leonard Gaythorne Carson Parker, R.N.,

Surgeon Lieutenant (D) Thomas Hugh Hamilton Murray,

commission in the rank of Probationary Surgeon Lieutenant, with

Doctor John Cainns Hamilton Barclay, M.R.C.S., L.R.C.P.,
granted a short-service commission in the rank of Probationary
Surgeon Lieutenant, with seniority of 30 May 1949, and appointed

Doctor W. T. Jones, M.B., Ch.B., granted a short-service
commission in the rank of Probationary Surgeon Lieutenant, with
seniority of 6 September 1949, and appointed H.M.N.Z.S. “Maori”,
additional, to date 6 September 1951.

Lieutenant (Sp.) Brian McKenzie Bary, M.Sc., promoted to
the rank of Lieutenant-Commander (Sp.), to date 12 April 1951.

Sub-Lieutenant (S) John Hugh Newcome Waymouth, promoted
to the rank of Lieutenant (S), to date 1 September 1951, and
reappointed.

Midshipmen David John Burgess, Tom Alexander Riddell, and
Michael Richard George Muschamp, promoted to the rank of Acting
Sub-Lieutenant, to date 1 September 1951, with seniority of 1
September 1951.

Cadets Douglas Brian Domett and Murray Charles Verran,
promoted to the rank of Midshipman, to date 1 September 1951,
with seniority of 1 September 1951.

Cadets (S) Campbell Munro Herbertson and John Adrian
Vennell, promoted to the rank of Midshipman (S), to date 1 September

Temporary Senior Commissioned Gunner John Caldecott
