Type 2.—Being sacks suitable for lime, coal, coke, or vegetables, other than potatoes or onions.
Grade A: Means sacks which are cleaned, sound, and free from holes, tears, and similar defects, other than tears and holes not exceeding six in number or 25 square inches in aggregate area; provided that no such tear or hole shall have a diameter exceeding 6 in. or a length exceeding 18 in., and all such tears and holes have been repaired.
Class F—Sugar-bags
Type 1.—Being once-shot sugar-bags.
Grade A: Means bags used previously for sugar only, and on not more than one occasion, which are cleaned, sound, and free from discoloration and from holes, tears, and similar defects, other than minor breaks in the texture not exceeding two in number or 2 square inches in aggregate area; provided that no such break shall exceed 3 in. in length, and all such breaks have been repaired.
Type 2.—Being other sugar-bags.
Grade A: Means bags which have been used more than once, but which are cleaned, sound, and free from holes, tears, and similar defects, other than tears and holes, not exceeding three in number or 12 square inches in total area; provided no such tear or hole shall exceed 12 in. in length or greatest diameter respectively, and all such tears and holes have been repaired.
Class G—Hessian Utility Bags
Type 1.—Being bags suitable for potatoes or other vegetables.
Grade A: Means bags which are cleaned and free from holes, tears, and similar defects, other than tears and holes not exceeding three in number or 12 square inches in aggregate area; provided that no tear or hole shall exceed 12 in. in length, and all such tears and holes have been repaired.
APPLICATION OF THIS ORDER
- This Order applies with respect to all sales of empty second-hand sacks and bags of any of the classes, descriptions, grades, or types specified in the Schedule hereto.
FIXING MAXIMUM SELLING-PRICE OF SECOND-HAND SACKS AND BAGS TO WHICH THIS ORDER APPLIES
- (1) Subject to the following provisions of this clause, the maximum price that may be charged or received by any person for second-hand sacks or bags to which this Order applies shall be the appropriate price in the Schedule hereto.
(2) The maximum price that may be charged or received by any person selling as a distributor for any second-hand sacks or bags to which this Order applies shall be the appropriate price fixed in the Schedule hereto reduced as follows:—
For sacks or bags in Classes A, B, C, D, and E . . . . . . . . By 1½d. each.
For sacks or bags in Classes F and G . . . . . . . . By 1d. each.
(3) Where any person (other than a second-hand sack merchant) selling as a reseller incurs transport charges into his store with respect to any sacks or bags purchased by him, the maximum prices fixed in the Schedule hereto may be increased by a proportionate amount of such charges, being not more in any case than the charges that would have been incurred if delivery into the reseller’s store had been effected by a common carrier at authorized rates.
(4) The maximum prices fixed as aforesaid are fixed as for delivery by the vendor free-on-board or free-on-rail at the port or railway-station (as the case may be) that is nearest or most convenient of access to the vendor’s premises.
(5) Where any sacks or bags to which this Order applies are delivered by a vendor otherwise than free-on-board or free-on-rail as aforesaid, the maximum price that may be charged by the vendor shall be the maximum price fixed as aforesaid, increased by any transport charges incurred by the vendor in effecting delivery and then reduced by the amount of the transport charges that would have been incurred if he had delivered the sacks or bags free-on-board or free-on-rail as aforesaid.
- Subject to such conditions, if any, as it thinks fit, the Tribunal, on application by any person concerned, may authorize special prices or margins of profit in respect of any sacks or bags to which this Order applies where special circumstances exist, or for any reason extraordinary charges (freight or otherwise) are incurred. Any authority given by the Tribunal under this clause may apply with respect to a specified lot or consignment of sacks or bags or may relate generally to all sacks or bags to which this Order applies sold while the approval remains in force.
