  1. LICENCE SUBJECT TO REGULATIONS

In respect of the lines hereby authorized, the licensee shall comply with the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, the Radio Interference Regulations 1934, and with any regulations made or to be made in amendment or amplification thereof or in substitution therefor.

  1. SYSTEM OF SUPPLY

The system of supply shall be as described in paragraphs (a) and (f) of clause 21–01 of the Electrical Supply Regulations 1935. The primary distribution voltage shall be 3,300 volts.

  1. DURATION OF LICENCE

This licence shall, unless sooner lawfully determined, continue in force until the 21st day of April, 1963.

SECOND SCHEDULE

LINES adapted for the distribution of electrical energy by the systems of supply hereinbefore described within all that area comprising approximately 14 acres, situated in Block I, Whakatane Survey District, South Auckland Land District, in the Borough of Whakatane, bounded by a line commencing at a point on the boundary of the Whakatane Borough, being the south-western corner of Allotment 233, Waimana Parish, and running southerly generally along a right line, being the production southwards of the eastern side of King Street, across a public road to its southern side; thence westerly and southerly generally along the southern side of the aforesaid public road, to and along the western boundary of part Allotment 11, Waimana Parish aforesaid, along a right line across Allotment 405 of the aforesaid Waimana Parish, and again along the western boundary of Allotment 11 aforesaid, to a point 250 links distant from the southern side of the aforesaid public road; thence again westerly generally along a right line 250 links distant from and parallel to the southern side of the aforesaid public road to its intersection with the eastern side of a public road, forming the western boundary of part of Allotment 8 of the said Waimana Parish; thence northerly generally along the eastern side of the said public road, and along a right line across another public road to the south-western corner of part Allotment 8, Waimana Parish aforesaid, as shown on the plan numbered 22007, deposited in the office of the District Land Registrar at Auckland, and being a point on the boundary of the Borough of Whakatane, as described in New Zealand Gazette No. 109 of the 31st day of October, 1940, page 2781; thence easterly generally along the aforesaid borough boundary to the point of commencement. The said area being more particularly shown bordered red on the plan marked S.H.D. 95, deposited in the office of the Minister in Charge of the State Hydro-electric Department; the electric lines at present proposed to be erected and used being shown by blue lines and broken red lines on the said plan S.H.D. 95.

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Timaru City Council to lay-off the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 feet, but not less than 45 feet, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the proposed street within a distance of 33 feet from the centre-line of the said street.

SCHEDULE

THAT proposed street in the Canterbury Land District, City of Timaru, to be known as Wallace Street, containing by admeasurement 3 roods 8·6 perches, more or less, being Lot 35, D.P. 14008, part Rural Section 1730. As the same is more particularly delineated on the plan marked P.W.D. 130960, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Napier City Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 feet, but not less than 40 feet, subject to the condition that no building or part of a building shall at any time be erected on the land shown edged green on the plan marked P.W.D. 133206, referred to in the said Schedule, within a distance of 33 feet from the centre-line of the said street.

SCHEDULE

THAT proposed street in the Hawke’s Bay Land District, City of Napier, being an extension of Ormond Avenue, containing by admeasurement 12·98 perches, more or less, being part Lot 6, D.P. 6452, being part Suburban Section 30, Napier.

As the same is more particularly delineated on the plan marked P.W.D. 133206, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

PURSUANT to section 31 of the Municipal Corporations Amendment Act, 1948, and section 125 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby authorize the Motueka Borough Council to permit the laying-off of the proposed street described in the Schedule hereto at a width for the whole of its length of less than 66 feet, but not less than 40 feet, subject to a condition that no building or part of a building shall at any time be erected on the land fronting the proposed street within a distance of 48 feet from the centre-line of the said street.

SCHEDULE

THAT proposed street in the Nelson Land District, Borough of Motueka, to be known as Selwyn Street, containing by admeasurement 1 rood 12 perches, more or less, being part Lot 21, D.P. 2212, and being part Section 154, District of Motueka.

As the same is more particularly delineated on the plan marked P.W.D. 133239, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

Foreshore Licence—Connecting Embankment—Rough Island to Rabbit Island—Nelson Harbour

At the Government Buildings at Wellington, this 6th day of February, 1951.

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to the Harbours Act, 1950, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby license and permit the Waimea County Council (hereinafter called the Council, which term shall include its successors or assigns, unless the context requires a different construction), to use and occupy a part of the foreshore and land below low-water mark between Rough Island and Rabbit Island in Nelson Harbour, as shown on plan marked M.D. 9110 and deposited in the office of the Marine Department at Wellington, for the purpose of erecting and maintaining a connecting embankment between Rough Island and Rabbit Island in Nelson Harbour, as shown on the said plan, such licence to be held and enjoyed by the Council upon and subject to the terms and conditions set forth in the Schedule hereto.

SCHEDULE

CONDITIONS

  1. THIS licence is subject to the Foreshore Licence Regulations 1940, and the provisions of those regulations shall, so far as applicable, apply hereto.

  2. The term of the licence shall be fourteen (14) years from the 1st day of February, 1951.

  3. The annual sum payable by the Council shall be one shilling (1s.) payable on demand to the Minister.

  4. In addition to the regulations contained in the Foreshore Licence Regulations 1940, the Council shall, if deemed necessary so to do, provide in the connecting embankment such width of waterway as is essential for the purposes of navigation.
