Vesting a Reserve in the Northland Hospital Board

ORDER IN COUNCIL

At the Government House at Wellington, this 26th day of September 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for hospital purposes:

And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Northland Hospital Board:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section 9 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that, from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Northland Hospital Board, in trust, for hospital purposes.

NORTH AUCKLAND LAND DISTRICT

SECTION 23, Block XV, Omapere Survey District: Area, 12 acres 2 roods 37 perches, more or less. Subject to the reservations and conditions imposed by section 59 of the Land Act, 1948, and subject also to the reservations imposed by section 8 of the Coal Mines Amendment Act, 1950. (S.O. plan 36479.)

Vesting the Control of Reserves in the Waiheke West Public Hall and Library Board

ORDER IN COUNCIL

At the Government House at Wellington, this 26th day of September, 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the lands described in the Schedule hereto have been duly set apart as sites for a library and hall respectively:

And whereas it is expedient that the control of the said reserves should be vested in a special Board as hereinafter provided:

Now, therefore, pursuant to Section 17 of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby vests the control of the reserves described in the Schedule hereto for the period of five years from the date hereof (unless previously amended or revoked under the said Act) in the undermentioned persons, namely,—

Ellen Armstrong,
Robert Burgess,
Francis James Cuthbert,
Arthur Martin Day,
Kenneth John Downey,
Yula Anne Jarvis,
Ethel Mary Nesbitt,
John William Smith, and
Herbert William Thompson,

who are hereby constituted for that purpose a special Board by the name of the Waiheke West Public Hall and Library Board (hereinafter referred to as the Board), with the powers and subject to the conditions hereinafter contained, that is to say:—

  1. The first meeting of the Board shall be held on Saturday, the 22nd day of September, 1951, at 3 o’clock p.m. at the Surfdale School, Oneroa, and thereafter the Board shall meet for the transaction of business at such time and place as may from time to time be fixed by the Board.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any five members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

  6. If by resignation, death, incapacity, or otherwise, the seat of any member shall be or become vacant, or if any member absents himself (or herself) without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his (or her) stead.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

  8. The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the 31st day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  9. The Board shall control the said reserves and the building erected thereon for the purposes of a library, and a hall, and shall also afford settlers and residents of Waiheke West and the surrounding district such facilities for meeting within the said building as may from time to time be determined by the Board; provided that the Board shall have power to fix reasonable charges for the use of the said building.

ALL those areas situated in Block V, Waiheke Survey District, containing by admeasurement a total of 1 rood 24 perches, more or less, being Lot 437 as shown on a plan deposited in the Land Registry Office at Auckland under No. 25861; and Lot 448 as shown on a plan deposited as aforesaid under No. 33180; both being parts Te Huruhi No. 5D Block.

Cancelling the Vesting of Portion of a Reserve in the Paparua County Council

ORDER IN COUNCIL

At the Government House at Wellington, this 26th day of September, 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS the land described in the Schedule hereto is portion of a reserve for gravel-pit purposes, and is vested, in trust, in the Paparua County Council:

And whereas it is expedient that the vesting of the said land as hereinbefore referred to should be cancelled, and the Paparua County Council has duly consented to such cancellation:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred upon him by subsection (1) of section 10 of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby cancel the vesting in the Paparua County Council of the land described in the Schedule hereto.

CANTERBURY LAND DISTRICT

ALL that area situated in Block XIII, Christchurch Survey District, containing by admeasurement 1 rood 16·8 perches, more or less, being part of Reserve 334, and being also part of the land comprised in Conveyance 12682, Deeds Reference C. 8568 (Canterbury Registry). As the same is more particularly delineated on the plan marked L. and S. 6/5/355B, deposited in the Head Office, Department of Lands and Survey at Wellington, and thereon edged red.

Revoking the Reservation Over Portion of a Reserve in Block XIII, Christchurch Survey District, Canterbury Land District

ORDER IN COUNCIL

At the Government House at Wellington, this 26th day of September, 1951

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

IN pursuance and exercise of the powers and authorities conferred upon him by subsection (1) (b) of section 7 of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the reservation for gravel-pit purposes over the land described in the Schedule hereto; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1948.
