The Eastern Side of Portion of Catherine Street, in the Borough of Onehunga, Exempted from the Provisions of Section 128 of the Public Works Act, 1928, Subject to a Condition as to the Building-line

At the Government Buildings at Wellington, this 31st day of January, 1951
Present:
THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL
PURSUANT to section 128 of the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Onehunga Borough Council on the 29th day of May, 1950, in so far as it affects the side and portion of street described in the Schedule hereto, viz. :
“ The Body Corporate called the Mayor, Councillors, and Burgesses of the Borough of Onehunga, being the local body having control of the streets in the Borough of Onehunga, by resolution declares that the provisions of section 128 of the Public Works Act, 1928, shall not apply to the eastern side of the portion of Catherine Street adjoining Lot 1 on a plan lodged for deposit in the Land Transfer Office at Auckland under No. 36957, being part of Allotment 6 of Section 22 of the Village of Onehunga, and being part of the land contained in Certificate of Title, Volume 593, folio 43, Auckland Registry ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portion of Catherine Street (described in the Schedule hereto) within a distance of 20 feet from the centre-line of the said portion of street.
SCHEDULE
THE eastern side of all that portion of street situated in the North Auckland Land District, Borough of Onehunga, known as Catherine Street, fronting Lot 1, Section 3, D.R.O. 1387, being part Allotment 6, Section 22, Village of Onehunga.
As the same is more particularly delineated on the plan marked P.W.D. 132428, deposited in the office of the Minister of Works at Wellington, and thereon coloured red.

IN pursuance and exercise of the power and authority vested in him by the Valuation of Land Act, 1925, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and direct that the District Valuation Roll for Tuapeka County shall be revised by the Valuer-General as at the 31st day of January, 1951.

Consenting to the Raising of a Loan of £2,433 by the Howick Town Board and Prescribing the Conditions Thereof

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL
WHEREAS the Howick Town Board (hereinafter called the said local authority) proposes, pursuant to the terms of a requisition issued under section 22 of the Health Act, 1920, to raise a loan of two thousand four hundred and thirty-three pounds (£2,433) to be known as “ Fenton Water Supply Loan, 1950 ” (hereinafter called the said loan), for the purpose of providing waterworks comprising the extension of the existing water reticulation to the area of the town district known as the Fenton subdivision :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of two thousand four hundred and thirty-three pounds (£2,433) and in giving such consent doth hereby determine as follows :—
(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty-five (25) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding three pounds five shillings (£3 5s.) per centum per annum.
(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand and no instalments shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Consenting to the Raising of a Loan of £500 by the Manawatu County Council and Prescribing the Conditions Thereof

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL
WHEREAS the Manawatu County Council (hereinafter called the said local authority) proposes, pursuant to the provisions of section 49 of the Fire Services Act, 1949, to borrow the sum of five hundred pounds (£500) by a loan to be known as “ Fire Services Loan, 1950 ” (hereinafter called the said loan) for the purpose of meeting the cost of purchase of a mobile unit for the Foxton Beach Volunteer Fire Brigade :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan for the said purpose up to the amount of five hundred pounds (£500) and in giving such consent doth hereby determine as follows :—
(1) The term for which the said loan or any part thereof may be raised shall be five (5) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said loan or any part thereof, together with interest thereon, shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.
(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

WHEREAS the Nelson City Council (hereinafter called the said local authority) proposes, pursuant to the terms of a requisition issued under section 22 of the Health Act, 1920, to raise a loan of five thousand nine hundred and fifty pounds (£5,950) to be known as “ Cemetery Loan, 1950 ” (hereinafter called the said loan), to provide a cemetery in Poorman’s Valley, Stoke :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan for the said purpose up to the amount of five thousand nine hundred and fifty pounds (£5,950) and in giving such consent doth hereby determine as follows :—
(1) The term for which the said loan or any part thereof may be raised shall not exceed fifteen (15) years.
