IN pursuance and exercise of the powers conferred by section 44 of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

Eric Hugh McLellan,
John Gilbert O’Hara,
Francis William Signal, and
Harold Albert Tucker,

to be the St. Helen’s Domain Board, having control of the land described in the Schedule hereto, and doth hereby appoint Saturday, the 14th day of July, 1951, at 2 o’clock p.m., as the time when, and the Aria War Memorial Library as the place where, the first meeting of the Board shall be held.

Additional Member Appointed to the Hikuai Public Hall Board

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by an Order in Council dated the 4th day of October, 1950, and published in the New Zealand Gazette of the 5th day of that month, the control of the land described in the Schedule to that document, being a reserve for a site for a public hall, was vested in certain persons therein named, who were by the said Order in Council constituted a special Board, by the name of the Hikuai Public Hall Board, in pursuance of section 17 of the Public Reserves, Domains, and National Parks Act, 1928:

And whereas it is considered desirable that the membership of the said Board should be increased:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers conferred on him by section 17 of the Public Reserves, Domains, and National Parks Act, 1928, and of all other powers and authorities enabling him in this behalf, doth hereby appoint

Leith Robert John Pattie

to be an additional member of the Hikuai Public Hall Board constituted by the Order in Council dated the 4th day of October, 1950, hereinbefore referred to.

Authorizing Dallis Hein Giles, of Clarence Bridge, Marlborough, Farmer, to Use Water for the Purpose of Generating Electricity

ORDER IN COUNCIL

At the Government House at Wellington, this 4th day of July, 1951

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby grant to Dallis Hein Giles, of Clarence Bridge, Marlborough, Farmer (hereinafter referred to as the licensee), a licence subject to the conditions hereinafter set forth, to take and use from an unnamed stream (hereinafter referred to as the said stream), situated in S.G.R. Part 112A, Blocks XII and XIV, Puhipuhi Survey District, for the purpose hereinafter set forth, a stream of water not exceeding 2 cubic feet per second at any one time.

CONDITIONS

  1. IMPLIED CONDITIONS

THE conditions directed to be implied in all licences by the Water-power Regulations 1934, and the Electrical Supply Regulations 1935 shall be incorporated in and shall form part of this licence except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENCE SUBJECT TO REGULATIONS

This licence is issued under the Water-power Regulations 1934, and is subject thereto and to the Electrical Supply Regulations 1935, the Electrical Wiring Regulations 1935, and the Radio Interference Regulations 1934, and to all regulations hereafter made in amendment thereof or in substitution therefor respectively.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS

Water shall be used under this licence solely for the purpose of generating electricity, and shall be taken from the said stream at a point in S.G.R. Part 112A, Blocks XII and XIV, Puhipuhi Survey District as indicated on the plan marked S.H.D. 150, deposited in the office of the Minister in Charge of the State Hydro-electric Department.

  1. GENERAL DESCRIPTION OF WORKS

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purpose of this licence; the position of the said works being indicated on the said plan S.H.D. 150:—

(a) Headworks consisting of an intake and water-race and pipeline leading to the Pelton-wheel and power-house hereinafter referred to, giving a static head of approximately 85 feet.

(b) Pelton wheel and power-house with all necessary equipment for generating electricity.

(c) Tail-race leading from the said power-house to the said stream.

  1. DURATION OF LICENCE

This licence, unless sooner lawfully determined, shall continue in force until the 31st day of March, 1972.

  1. SYSTEM OF SUPPLY

The system of supply shall be as described in paragraph (d) of clause 21–01 of the Electrical Supply Regulations 1935, and shall be direct current.

  1. RENTAL

For the purpose of assessing the rental or annual sum payable in respect of this licence the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the State Hydro-electric Department, and failing such installation, the rental shall be assessed on the maximum generating-capacity of the plant installed. The present plant is rated at 0·6 kilowatts.

  1. NO RIGHT TO WATER CONFERRED

Nothing in this licence shall of itself confer upon the licensee any right to water.
