Consenting to the Raising of the Balance (£11,100) of the Westland Catchment Board’s Loan of £15,000 and Prescribing the Conditions Thereof

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the 14th day of July, 1948, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Westland Catchment Board (hereinafter called the said local authority) of a loan of fifteen thousand pounds (£15,000) to be known as “Plant Loan, 1948” (hereinafter called the said loan):

And whereas the authority conferred by the said Order in Council has lapsed in accordance with the provisions of clause (4) of the said Order in Council, and it is not now lawful or competent for the said local authority to raise the said loan or any portion thereof except in accordance with the provisions of a further Order in Council that may be issued pursuant to section 11 of the Local Government Loans Board Act, 1926 (hereinafter called the said Act):

And whereas an amount of eleven thousand one hundred pounds (£11,100) (hereinafter called the said sum) has not yet been raised and it is expedient to authorize the said local authority to raise the said sum on the conditions hereinafter set out:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the said Act, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said sum up to the amount of eleven thousand one hundred pounds (£11,100) for the purpose for which the said loan was authorized and in giving such consent doth hereby determine as follows:—

(1) The term for which the said sum or any part thereof may be raised shall not exceed eight (8) years.

(2) The rate of interest that may be paid in respect of the said sum or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.

(3) The said sum or any part thereof, together with interest thereon shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.

(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Revoking the Declaration of Main Highways and Declaring Public Highways to be Main Highways

IN pursuance and exercise of the powers and authorities vested in him by section 3 of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that, on and after the date of publication of this Order in Council in the New Zealand Gazette, the main highways described in the First Schedule hereto shall cease to be main highways, and doth further declare that the roads described in the Second Schedule shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.

FIRST SCHEDULE

HIGHWAY DISTRICT NO. 2B

Ahoroa–Tapairu.—All that main highway or portion of main highway in the Te Kuiti Borough declared as the Ahoroa–Tapairu Main Highway, described in Order in Council dated 2nd July, 1928, and published in the New Zealand Gazette on 5th July, 1928.

Matamata Station.—All that main highway or portion of main highway in the Matamata Borough declared as the Matamata Station Main Highway, described in Order in Council dated 16th December, 1935, and published in the New Zealand Gazette on 19th December, 1935.

HIGHWAY DISTRICT NO. 8

National Park – Wanganui.—All that main highway or portion of main highway in the Wanganui County declared as the National Park – Wanganui Main Highway, commencing at a point approximately 20 chains in a westerly direction from its junction with Matatara Road; thence in a north-easterly direction through Whataroa Block, adjacent to the south-eastern corner of Pourewa Block, through Matekahu Block, Block XV, Waipakura Survey District; thence through Upokongaro No. 2 Block, Block XI, Waipakura Survey District, to a point approximately 32 chains north-east of the southern boundary of Upokongaro No. 2 Block, being a distance of 107 chains, more or less, described in Order in Council dated 2nd October, 1940, and published in the New Zealand Gazette on 10th October, 1940; as the same is more particularly delineated on plan P.W.D. 132163, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

HIGHWAY DISTRICT NO. 9A

Sans on – Palmerston North.—All that main highway or portions of main highway in the Kairanga County, and also now in part lying within the Palmerston North City Boundary, declared as the Sanson – Palmerston North Main Highway, described in Order in Council dated 2nd October, 1940, and published in the New Zealand Gazette on 10th October, 1940, having the Palmerston North City Boundary along its centre-line, and commencing at the junction of Rangitikei Line and the centre-line of Richardson’s Line, and proceeding thence generally in a south-easterly direction along Rangitikei Line to a point opposite the north-western boundary of Lot 1, D.P. 10583, being part of Rural Section 554, Township of Palmerston North, being a distance of 24 chains, more or less.

Also all that portion of the Sanson – Palmerston North Main Highway in the Palmerston North City area, commencing at the point in Rangitikei Line opposite the north-western boundary of Lot 1, D.P. 10583, being part of Rural Section 554, Township of Palmerston North, and proceeding thence generally in a south-easterly direction and terminating at the point on Rangitikei Line opposite the south-eastern side of Boundary Road, being a distance of 50 chains, more or less.

As the above main highway or portions of main highway are more particularly delineated on plan P.W.D. 133570, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

Milsons Line.—All that main highway or portions of main highway in the Kairanga County, and also now in part lying within the Palmerston North City Boundary, declared as the Milsons Line Main Highway, described in Order in Council dated 13th November, 1934, and published in the New Zealand Gazette on 15th November, 1934, having the Palmerston North City Boundary along its centre-line, and commencing at the junction of Milsons Line and the centre-line of Richardson’s Line, and proceeding thence generally in a south-easterly direction along Milsons Line to a point opposite the north-western boundary of Rural Section 555, Township of Palmerston North, being a distance of 24 chains, more or less.

Also all that portion of the Milsons Line Main Highway in the Palmerston North City area, commencing at the point on Milsons Line opposite the north-western boundary of Rural Section 555, Township of Palmerston North, and proceeding thence generally in a south-easterly direction, and terminating at a point at the south-east end of Milsons Line on the south-eastern side of Boundary Road, being a distance of 63 chains, more or less.

As the above main highway or portions of main highway are more particularly delineated on the plan P.W.D. 133568, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

HIGHWAY DISTRICT NO. 9B

Te Horo – Waihoanga.—All that main highway or portion of main highway in the Horowhenua County declared as the Te Horo – Waihoanga Main Highway, described in Order in Council dated 2nd April, 1928, and published in the New Zealand Gazette on 5th April, 1928.

HIGHWAY DISTRICT NO. 11

Blenheim–Nelson.—All that main highway or portion of main highway in the Marlborough and Awatere Counties declared as the Blenheim–Nelson Main Highway, described in Order in Council dated 12th November, 1947, and published in the New Zealand Gazette on 20th November, 1947.

Nelson–Westport.—All that main highway or portion of main highway in the Waimea and Murchison Counties and the Tahunanui Town District declared as the Nelson–Westport Main Highway, described in Order in Council dated 9th June, 1924, and published in the New Zealand Gazette on 12th June, 1924.

Nelson–Aerodrome.—All that main highway or portion of main highway in the Waimea County and the Tahunanui Town District declared as the Nelson–Aerodrome Main Highway, described in Order in Council dated 13th December, 1938, and published in the New Zealand Gazette on 21st December, 1938.

HIGHWAY DISTRICT NO. 13

Beach Road.—All that main highway or portion of main highway in the Kaikoura County declared as the Beach Road Main Highway, described in Order in Council dated 2nd April, 1928, and published in the New Zealand Gazette on 5th April, 1928.

Picton–Christchurch.—All that main highway or portion of main highway in the Kaikoura County, commencing at the junction of Churchill Street and Killarney Road, in the township of Kaikoura, thence proceeding generally in an easterly and northerly direction along Killarney Road, New Street, Yarmouth Street, Beach Road, and West End Parade, and terminating at its junction with Ludstone Terrace on the south bank of the Lyell Creek, being a distance of 1 mile 20 chains, more or less, described in Order in Council dated 3rd March, 1948, and published in the New Zealand Gazette on 16th March, 1948.

HIGHWAY DISTRICT NO. 18

Riversdale–Waikai a.—All that main highway or portion of main highway lying within the township of Waikai a declared as the Riversdale–Waikai a Main Highway, described in Order in Council dated 9th June, 1924, and published in New Zealand Gazette on 12th June, 1924.
