ORDER IN COUNCIL

At the Government Buildings at Wellington, this 8th day of May, 1951

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 5 of the Maori Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Maori freehold land described in the Schedule hereto as a Maori reservation for the common use of the members of the Ngati Whatua tribe living at Oruawharo as a marae.

SCHEDULE

ALL that area of land containing 3 acres 1 rood 8·1 perches, more or less, situate in Block X of the Otamatea Survey District, called or known as Oruawharo A 4A (formerly part Oruawharo A 6 containing 1 acre 1 rood 12 perches, and Oruawharo A 4A containing 1 acre 3 roods 36·1 perches), and being the whole of the land in Partition Order of the Maori Land Court dated 17th December, 1947. As the same is more particularly delineated on the plan marked M.A. 21/3/232, deposited in the Head Office of the Department of Maori Affairs at Wellington, and thereon edged red.

Authorizing the Acquisition of Land Notwithstanding the Provisions as to Limitation of Area

ORDER IN COUNCIL

At the Government Buildings at Wellington, this 8th day of May, 1951

Present:

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 246 of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council doth hereby authorize the disposition to and acquisition by Harry Wallis Barker, Percival Frank Barker, and Derek Brayton Barker, all of Gisborne, Sheep-farmers, by way of sale of the land mentioned in the Schedule hereto, notwithstanding the provisions of Part XII of the said Act.

SCHEDULE

ALL that parcel of land situated in the Borough of Gisborne containing 2 roods 6·14 perches, more or less, being part of the Kaiti 199 Block, and being the whole of the land in Certificate of Title, Volume 55, folio 232 (Gisborne Registry).

Authorizing the Acquisition of Land Notwithstanding the Provisions as to Limitation of Area

At the Government Buildings at Wellington, this 8th day of May, 1951

THE RIGHT HON. S. G. HOLLAND PRESIDING IN COUNCIL

PURSUANT to section 246 of the Maori Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby authorize the disposition to and acquisition by Konga Wharetuanui, of Ohinemama, Chatham Islands, Sheep-farmer, by way of sale of the land described in the Schedule hereto, notwithstanding the provisions of Part XII of the said Act.

SCHEDULE

ALL that area of land in the Wellington Land District, containing 876 acres 35 perches, more or less, situate in the Chatham Islands, being part of the Maori Land Court subdivision known as Otonga 1E 4A 2 and being all the land comprised and described in Certificate of Title, Volume 395, folio 157 (Wellington Registry).

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby consent to the assignment to Patrick Charles Fossitt Holland, of “Knocklofty”, Clinton, Farmer, by Stanley Alfred Lee of “Willowburn”, Clinton, Farm-manager, of his rights, powers, and privileges under an Order in Council dated the 27th day of August, 1934, and published in the New Zealand Gazette on the 30th day of the same month at page 2742, authorizing Frank Hudson and Locke Darling, both of “Willowburn”, Clinton, to use water for the purpose of generating electricity, which rights, powers, and privileges were previously assigned by the said Frank Hudson and Locke Darling to the said Stanley Alfred Lee.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council, doth hereby consent to the land described in the Schedule hereto, together with and subject to the party-wall easement created by Memorandum of Transfer No. 168301 (Canterbury Land Registry) and together with the benefit of the right-of-way created by Memorandum of Transfer No. 63268 (Canterbury Land Registry), being taken for public offices.

SCHEDULE

APPROXIMATE area of the piece of land permitted to be taken: 15·61 perches.

Being part Lot 2, D.P. 1911, being part Town Sections 684 and 686, and being the whole of the land comprised and described in Certificate of Title, Volume 385, folio 285 (Canterbury Land Registry).

Varying the Determinations in Respect of the Balance (£11,000) of the Dunedin City Council’s Loan of £25,000

Present:

THE HON. K. J. HOLYOAKE PRESIDING IN COUNCIL

WHEREAS by Order in Council made on the 1st day of June, 1949 (hereinafter called the said Order in Council), and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Dunedin City Council (hereinafter called the said local authority) of the sum of eleven thousand pounds (£11,000) (hereinafter called the said sum) being the balance then unraised of a loan of twenty-five thousand pounds (£25,000) known as “Housing Loan, 1945”:

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to extend the term as specified in clause (6) of the said Order in Council within which the said sum or any portion thereof may be raised:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section 11 of the Local Government Loans Board Act, 1926, as set out in section 29 of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said sum by prescribing that no moneys shall be borrowed under the consent given by the said Order in Council after the expiration of four (4) years from the date thereof.
