Road Traversing Maori Land Proclaimed as a Public Road in Blocks XII and XVI, Muriwhenua Survey District, North Auckland Land District

A PROCLAMATION

WHEREAS the road described in the Schedule hereto traverses Maori Land and has been used by the public as a public road and has been formed, improved, or maintained out of public funds:

And whereas the Maori Land Court, by an order made on the 25th day of November, 1948, and issued pursuant to section 484 of the Maori Land Act, 1931, ordered and declared the said road to be a public road:

And whereas the said Court is of the opinion that it is in the public interest that the said road should be proclaimed as a public road, and a notification to that effect has been forwarded to the Minister of Lands in terms of section 486 of the Maori Land Act, 1931:

And whereas it is now expedient that the said road should be proclaimed as a public road:

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred by section 487 of the Maori Land Act, 1931, do hereby proclaim as a public road the road described in the Schedule hereto.

In the North Auckland Land District; as the same are more particularly delineated on the plan marked L. and S. 16/3160, deposited in the Head Office, Department of Lands and Survey, at Wellington, under No. 3062, and thereon coloured as above mentioned.

Given under the hand of His Excellency the Governor-General of the Dominion of New Zealand, and issued under the Seal of that Dominion, this 11th day of May, 1951.

Declaring Lands in North Auckland, Nelson, and Canterbury Land Districts, Vested in the Auckland, Nelson, and Canterbury Education Boards as Sites for Public Schools, to be Vested in His Majesty the King

A PROCLAMATION

WHEREAS by subsection (6) of section 5 of the Education Lands Act, 1949 (hereinafter referred to as the said Act), it is provided that notwithstanding anything contained in any other Act, the Governor-General may from time to time, by Proclamation declare that any school-site or part of a school-site which in his opinion is no longer required for that purpose shall be vested in His Majesty; and thereupon the school-site or part thereof, as the case may be, shall vest in His Majesty freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date of the Proclamation.

Now, therefore, I, Lieutenant-General Sir Bernard Cyril Freyberg, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred by subsection (6) of section 5 of the said Act, do hereby proclaim and declare that the land described in the First Schedule hereto, being an area vested in the Auckland Education Board, the land described in the Second Schedule hereto, being an area vested in the Nelson Education Board, and the lands described in the Third Schedule hereto, being areas vested in the Canterbury Education Board, as sites for public schools, shall be vested in His Majesty the King, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

FIRST SCHEDULE

NORTH AUCKLAND LAND DISTRICT

ALL that area situated in Block VII, Tauhoa Survey District, containing by admeasurement 2 acres, more or less, being part of Allotments M.22 and S.22, Tauhoa Parish, and being all the land comprised and described in Certificate of Title, Volume 597, folio 236 (Auckland Registry).

SECOND SCHEDULE

NELSON LAND DISTRICT

ALL that area, containing by admeasurement 1 acre 2 roods 9 perches, more or less, being part of Sections 133 and 169, District of Waimea West, situated in Block V, Waimea Survey District, and being all the land comprised and described in Certificate of Title, Volume 107, folio 125 (Nelson Registry). (S.O. Plans 9604 and 9627.)

THIRD SCHEDULE

CANTERBURY LAND DISTRICT

ALL that area situated in Block I, Pareora Survey District, containing by admeasurement 2 acres, more or less, being part Rural Section 18893, and being all the land comprised and described in Certificate of Title, Volume 129, folio 220 (Canterbury Registry).
