Notice by the Public Trustee Under the Public Trust Office Act, 1908, Part III, and its Amendments

WHEREAS HERMAN AUGUSTUS HARTKE, of Hokitika, in the Dominion of New Zealand, Retired Miner, is the owner of the property described in the Schedule hereto: And whereas it is not known where the said HERMAN AUGUSTUS HARTKE is or whether he is alive or dead: And whereas the said HERMAN AUGUSTUS HARTKE has no known agent in New Zealand with authority to take possession of and administer such property: And whereas by an Order of a Judge of the Supreme Court of New Zealand made on the 22nd day of March, 1951, pursuant to the provisions of section 87 of the Public Trust Office Act, 1908, as amended by section 21 of the Finance Act, 1936 (No. 2), the Public Trustee was authorized to exercise in respect of the property of the said HERMAN AUGUSTUS HARTKE all or any of the powers contained in paragraphs (a), (b), (c), (d), (e), (f), (g), (h), (j), and (k) of the said section 87, as so amended, and also the following additional power pursuant to paragraph (o) of the said section 87, as so amended, namely:—

“To apply moneys received by him in repairing and keeping in good order, repair, and condition any part of the property of the missing person.”

And whereas it is provided by section 89 of the Public Trust Office Act, 1908, that on taking possession of any property under Part III of the said Act the Public Trustee shall publish in the Gazette and in some newspaper circulating in the district where the property is situate a notice of his intention to exercise the powers conferred upon him by virtue of Part III of the said Act: Now, the Public Trustee hereby gives notice of his intention to exercise the powers conferred upon him by the said Order of a Judge of the Supreme Court of New Zealand.

SCHEDULE

(a) Cash held by Public Trustee.
(b) Post Office Savings-bank Account.
(c) Hokitika Savings-bank Account.
(d) Jewellery, clothing, and personal effects.
(e) Accrued Age-benefit.
(f) Furniture and household effects.
(g) Realty situate at 133 Brittan Street, Hokitika.

Notice by the Public Trustee Under the Public Trust Office Act 1908, Part III

WHEREAS JOHN BUNYAN YOUNG, of Wellington, in New Zealand, Company Director, is the owner of certain property, including that described in the Schedule hereto: And whereas it is not known whether the said JOHN BUNYAN YOUNG is alive or dead: And whereas by an Order of the Right Honourable the Chief Justice of New Zealand, made on the 21st day of March, 1951, pursuant to the provisions of section 87 of the Public Trust Office Act, 1908 (as amended by section 21 of the Finance Act, 1936 (No. 2), the Public Trustee was authorized to exercise, in respect of the property of the said JOHN BUNYAN YOUNG, all or any of the powers contained in paragraphs (a), (b), (d), (e), (f), (g), (h), (i), (j), (k), (l), (m), and (n) of the said section 87, as so amended, and also the additional powers mentioned in the said order (including powers relating to shares in J. B. Young and Company, Limited, and to the management and control of the said Company): Now, therefore, in pursuance of section 89 of the Public Trust Office Act, 1908, the Public Trustee hereby gives notice of his intention to exercise the powers conferred upon him by the said Order of the Right Honourable the Chief Justice by virtue of Part III of the said Act.

Shares in J. B. Young and Company, Limited.
Unpaid purchase-money on sections at Tawa Flat and Johnsonville.
Life-insurance covers (Dominion Life Assurance Office of N.Z., Ltd.).
House properties at 86 and 89 Breaker Bay Road, Wellington.
Sections at Hataitai and Khandallah.
Furniture, tools, effects, motor-car, yachting-gear and dinghy.

NOTICE is hereby given that pursuant to and in exercise of the powers conferred upon me by section 22 of the Industrial Conciliation and Arbitration Act, 1925, the registration of the Auckland Stationery Manufacturers Industrial Union of Employers, registered No. 1776, situated at Auckland, will, unless cause to the contrary be shown, be cancelled at the expiration of six weeks from the date of the publication of this notice in the Gazette.

Lesser Depths Reported

Position: Fairchild Reef, Lat., 36° 23·5 S.; long., 174° 51·5 E. (approx.).
Details: Yachtsmen report that the charted depths between Fairchild Reef and Kawau Island are considerably in error, as although depths of 5 and 6 fathoms are indicated on chart 1998 actual depths of 5 to 8 feet with patches of less than 3 feet at M.L.W.S. were observed. Mariners and others are warned to avoid using this channel until a detailed survey has been made, and to insert the notation “foul ground” between Fairchild Reef and Slip Island.

Law Practitioners Amendment Act, 1935

PURSUANT to the Law Practitioners Amendment Act, 1935, notice is hereby given that the Disciplinary Committee of the New Zealand Law Society on the 26th day of January, 1951, ordered that the name of George Israel Joseph, of Wellington, be struck off the rolls of Barristers and Solicitors of the Supreme Court of New Zealand and that he pay the sum of seventy-five guineas costs.

PURSUANT to the Law Practitioners Amendment Act, 1935, notice is hereby given that the Disciplinary Committee of the New Zealand Law Society on the 24th day of January, 1951, ordered that the name of John Keith Moloney, of Christchurch, be struck off the rolls of Barristers and Solicitors of the Supreme Court of New Zealand and that he pay the sum of thirty-one pounds ten shillings costs.
