The Servicemen's Settlement and Land Sales Act, 1943.—Notice Declaring Lands Taken for the Settlement of Discharged Servicemen.

WHEREAS, pursuant to section 24 of the Servicemen's Settlement and Land Sales Act, 1943, notice was given of the intention of the Minister of Lands to take, under Part II of the said Act, the lands described in the First Schedule hereto, and a copy of the said notice was published in the New Zealand Gazette No. 15 on the 10th day of March, 1949, at page 708 :
And whereas an objection was made by the owner in the manner prescribed by the said Act objecting to the taking of the said lands and claiming the right to retain part of the said lands :
And whereas the Minister of Lands did not revoke his notice of intention to take the said lands :
And whereas the Land Valuation Committee to which the said objection was referred did on the 16th day of November, 1949, make an order disallowing the said objection and limiting the area to be acquired by the Crown and determining the land to be farm land suitable or adaptable for the settlement of a discharged serviceman or of discharged servicemen :
And whereas no appeal from the said order was made within the time prescribed by the said Act :
And whereas at the request of the owner the Minister of Lands did agree to limit further the area to be taken to the land described in the Second Schedule hereto :
And whereas the said land is not the land of any serviceman who is for the time being serving outside New Zealand in any of His Majesty's Forces or in any British ship :
Now, therefore, the Minister of Lands, acting in pursuance of section 27 of the said Act, doth hereby declare that the land described in the said Second Schedule is taken for the settlement of discharged servicemen, and hereby specifies the 13th day of April, 1951, as the date on which the said land shall be deemed to be vested in His Majesty the King.

FIRST SCHEDULE
WESTLAND LAND DISTRICT
ALL that parcel of land containing by admeasurement ten (10) perches, more or less, being Section 3051, Block I, Toaroha Survey District, and being all the land described in Certificate of Title, Volume 26, folio 36 (Westland Registry.)
Also all that parcel of land containing by admeasurement one hundred and six (106) acres ten (10) perches, more or less, being Subdivision 5 on Deposited Plan 467 of Lot I of Section 1561, Block I, Toaroha Survey District, and being all the land described in Certificate of Title, Volume 24, folio 169 (Westland Registry).
Also that parcel of land containing by admeasurement six hundred and ninety-one (691) acres thirty-five (35) perches, more or less, being Lot 2 on Deposited Plan 381, being part Section 1561, Block I, Toaroha Survey District, and being all the land described in Certificate of Title, Volume 23, folio 2 (Westland Registry).
Also all that parcel of land containing by admeasurement forty-nine (49) acres, more or less, being Section 985, Block V, Toaroha Survey District, and being all the land described in Certificate of Title, Volume 20, folio 178 (Westland Registry).
Also all that parcel of land containing by admeasurement one hundred (100) acres, more or less, being Section 719, Block V, Toaroha Survey District, and being all the land described in Certificate of Title, Volume 11, folio 136 (Westland Registry).
Also all that parcel of land containing by admeasurement ninety-five (95) acres, more or less, being Section 984, Block VI, Toaroha Survey District, and being all the land described in Certificate of Title, Volume 20, folio 147 (Westland Registry).
Also all that parcel of land containing by admeasurement thirty-seven (37) acres, more or less, being Section 1214, Block IX, Kaniere Survey District, and being all the land described in Certificate of Title, Volume 27, folio 213 (Westland Registry).
Also all that parcel of land containing by admeasurement one hundred and five (105) acres, more or less, being Section 1217, Block IX, Kaniere Survey District, and being all the land described in Certificate of Title, Volume 5, folio 1458 (Westland Registry).
Also all that parcel of land containing by admeasurement twenty-one (21) acres two (2) roods, more or less, being part Section 1225, Block IX, Kaniere Survey District, and being all the land described in Certificate of Title, Volume 20, folio 171 (Westland Registry).

SECOND SCHEDULE
WESTLAND LAND DISTRICT
ALL that parcel of land containing by admeasurement ninety-five (95) acres more or less, being Section 984, Block VI, Toaroha Survey District, and being all the land comprised and described in Certificate of Title, Volume 20, folio 147 (Westland Registry).
Also all that parcel of land containing by admeasurement seventy-five (75) acres and twenty (20) perches, more or less, being part Section 719, Block V, Toaroha Survey District, and being part of the land comprised and described in Certificate of Title, Volume 11, folio 136 (Westland Registry), shown edged red on S.O. plan 4539, deposited in the office of the Chief Surveyor, Hokitika.

Agreement for Grant of Water Easement in Favour of Dixon's Limited, of Palmerston North, Cordial Manufacturers, Over Land Situated in the City of Palmerston North, Taken for a Milk-treating House, Assented to

WHEREAS by an agreement dated the 12th day of October, 1949, Dixon's Limited, of Palmerston North, Cordial Manufacturers, agreed to His Majesty the King taking, under the Public Works Act, 1928, an area of land containing approximately 1 rood 15·76 perches, situated in the City of Palmerston North, being part of Section 847, Township of Palmerston North, Block XI, Kairanga Survey District, for a milk-treating house :
And whereas the said Dixon's Limited is entitled to receive compensation for its freehold interest in the said area of 1 rood 15·76 perches :
And whereas the Minister of Works has agreed to grant to the said Dixon's Limited a proper easement to take water from the artesian well on the said area, and to provide a sum of money in satisfaction of the residue of the said compensation :
And whereas the said Dixon's Limited has agreed to accept such Grant of Easement and the sum of money in satisfaction of the said compensation :
Now, therefore, the Minister of Works hereby gives notice, pursuant to section 97 of the Public Works Act, 1928, that he assents to the agreement hereinbefore referred to.

Notice of Intention to Take Land in Block VI, Awaateatua Survey District, for a Main Highway Depot

NOTICE is hereby given that it is proposed, under the provisions of the Public Works Act, 1928, to take the land described in the Schedule hereto for a Main Highway depot ; and notice is hereby further given that the plan of the land so required to be taken is deposited in the post-office at Matata and is there open for inspection ; and that all persons affected by the taking of the said land should, if they have any well-grounded objections to the taking of such land, set forth the same in writing and send such writing, within forty days from the first publication of this notice, to the Minister of Works at Wellington.

Exemption Order Under the Motor-drivers Regulations 1940
———
PURSUANT to the Motor-drivers Regulations 1940, the Minister of Transport doth hereby order and declare that the provisions of clause (1) of regulation 7 of the said regulations, so far as they relate to the driving of heavy trade motors, shall not apply to the persons hereinafter mentioned, but in lieu thereof the following provision shall apply :—
A motor-driver's licence issued under the Motor-drivers Regulations 1940 to any one of the persons described in Column 1 of the Schedule hereunder may authorize him to drive a heavy trade motor in the course of his employment on a farm or market garden of the respective employer described in Column 2 of the said Schedule, but shall not authorize him, while he is under the age of eighteen years, to drive a heavy trade motor for any other purpose.

Exemption from Warrant of Fitness Requirements in Great Barrier Island
———
PURSUANT to the Traffic Regulations 1936, the Minister of Transport doth hereby revoke the Warrant* dated the 4th day of October, 1949, exempting any motor-vehicle while operated solely within the Chatham Islands or the Great Barrier Island from the provisions of clause (1) of regulation 11 of the Traffic Regulations 1936, and doth hereby exempt from the provisions of clause (1) of the said regulation 11 any motor-vehicle while operated solely within the Great Barrier Island.
